For parents, that money can help cover housing, school and daily care for your children. Good term life insurance parents children protection planning comes down to three choices: who owns the policy, who gets paid, and how the money reaches the kids.

NR CPAs & Business Advisors is a Miami CPA firm. Insurance is offered by Nischay Rawal, a licensed insurance agent, separately from the firm’s accounting practice. This page explains the tax and Florida rules that matter most for families with children.

What term life insurance does for children

Term life insurance gives a set amount of coverage for a set number of years. It fits best when your children depend on your income for a defined period of time.

FINRA notes that term coverage lasts for a limited period. Whole or permanent policies last for life and include a cash value feature. Coverage under a term policy ends when the term ends.

Colorado’s insurance regulator states that term life insurance is typically less expensive than cash-value policies. Cash-value premiums also fund the cash value, which explains the difference.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Who should own the policy and who should be the beneficiary?

The owner controls the policy. The beneficiary receives the death benefit. Keeping these roles clear is one of the most important parts of family planning.

Florida law lets an adult of legal capacity buy insurance on his or her own life for the benefit of any person. A parent can also buy insurance on a child’s life. The parent needs an insurable interest, which includes a close tie by blood or law with a substantial interest based on love and affection (Florida Statutes § 627.404).

The insurable interest need not exist after the coverage starts (Florida Statutes § 627.404).

Ownership carries real control. The rights to change the beneficiary, surrender or cancel the policy, assign it, or borrow against its cash value are called incidents of ownership. The term “incidents of ownership” is not limited in its meaning to ownership of the policy in the technical legal sense. Under the federal estate tax regulation on life insurance proceeds, “incidents of ownership” is not limited to owning the policy in the technical legal sense: it broadly refers to the insured’s or the estate’s right to the policy’s economic benefits, such as the power to change the beneficiary, surrender or cancel the policy, assign it, revoke an assignment, pledge it for a loan, or obtain a loan from the insurer against its surrender value.

Naming a minor child as beneficiary

Children under adult age usually can’t manage a large payout on their own. Many families plan for this in advance. They may name a trust or a trusted adult to hold and manage the money until the child is older. The beneficiary choice should match how you want the money used.

How the death benefit is taxed and counted in the estate

Life insurance death benefits are generally not income tax for the person who receives them. Where a life insurance contract, or any interest in it, is transferred for a valuable consideration, by assignment or otherwise, the amount of death proceeds excluded from gross income may not exceed the sum of the actual value of that consideration and the premiums and other amounts subsequently paid by the transferee, although the statute lists transfers to which that limit does not apply (IRC § 101).

Income tax and estate tax are different questions. Estate tax rules can still count the proceeds.

Estate inclusion rules

Proceeds count in your gross estate if the executor receives them. Under IRC § 2042, the gross estate includes the amount receivable by beneficiaries other than the executor as insurance under policies on the decedent’s life when the decedent possessed at death any of the incidents of ownership, exercisable either alone or in conjunction with any other person. IRC § 2042 reads: “For purposes of the preceding sentence, the term “incident of ownership” includes a reversionary interest (whether arising by the express terms of the policy or other instrument or by operation of law) only if the value of such reversionary interest exceeded 5 percent of the value of the policy immediately before the death of the decedent.”

For calendar year 2026, the basic exclusion amount under § 2010(c)(3) is increased to $15,000,000 (IRS guidance for 2026). The estate tax question matters most for estates that approach that amount. The ownership rules still matter for planning at any size.

Ownership at death

If you held any incidents of ownership in a policy at death, exercisable alone or together with another person, the proceeds are included in your estate.

Timing matters. A change in ownership should be planned before it happens, not after.

Gift tax when money funds a trust

Money a parent moves into a trust for children can be a gift. For 2026, the gift tax annual exclusion is $19,000 per donee (IRS, Frequently Asked Questions on Gift Taxes). Premium funding and gifts should be tracked together.

Florida rules that shape a family plan

Florida law sets several rules that affect a term policy. Knowing them helps you avoid surprises.

Grace period. Florida requires every insurance contract to give at least 30 days to pay any premium after the first. The policy stays in force during that period (Florida Statutes § 627.453).

Contestability. After two years from the issue date, the policy becomes incontestable. Exceptions include nonpayment of premiums (Florida Statutes § 627.455).

Misstated age. If the insured’s age was misstated, the benefit changes. It becomes the amount the premium would have bought at the correct age or sex (Florida Statutes § 627.456).

Creditors and the estate. For a Florida resident, proceeds go to the person named in the policy. They are exempt from the insured’s creditors unless the policy or a valid assignment provides otherwise. If the policy pays the insured’s estate, the proceeds become part of the estate (Florida Statutes § 222.13).

Have questions about what happened?

Ask our team directly.
