Before you change a whole life policy, review what it pays, what it costs, and how much cash value it holds. A switch can end coverage, reduce cash value, or create a tax bill, so the review comes first. This page covers that review for U.S. whole life policies and for an LIC policy issued in India. Nischay Rawal, a licensed insurance agent, handles the insurance side at NR CPAs & Business Advisors.

Why a whole life policy is worth reviewing before you change it

A whole life policy is permanent coverage with a death benefit, a premium schedule, and cash value. The insurer and the policy form set its terms, so the documents answer most early questions.

Many people hold a policy they did not choose. A parent may have bought it, or a relative may have set it up for you. Common reasons to review it include:

Your income has dropped, and the premium is harder to pay.

A new dependent needs protection.

You moved to the U.S. and now hold an LIC policy from India.

A parent’s policy is in your name, or you inherited it.

Comparing whole life insurance vs LIC policy starts with the same questions. Who is the insurer? What is the death benefit? What are the premiums? What do the surrender and loan terms say? Your own documents hold those answers.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

What your policy covers and what a switch could change

Your policy documents show what you own and what a change would affect. Pull these items first:

The insured person and the owner

The face amount and death benefit options

The premium, and how many years you pay it

Any riders, and any change in face amount or premium by age

Cash value needs care. Guaranteed values and non-guaranteed values are different, so read them separately. The American Academy of Actuaries says illustrations show how a policy works, but they are not reliable tools for projecting future performance. Dividends are not guaranteed. The Society of Actuaries notes that nonforfeiture options, cash surrender value, and premium cessation all affect a policy’s value.

A policy loan borrows against cash value. Under Fla. Stat. § 627.458, a policy may provide that, if loan interest is not paid when due, the unpaid interest is added to the debt. If the debt reaches the loan value, the policy can end, but not until at least 30 days’ notice is mailed.

A surrender ends the policy for its cash surrender value, and surrender charges can lower that amount. Fla. Stat. § 627.458 reads: “The loan value of the policy shall be at least equal to the cash surrender value at the end of the then-current policy year, except that the insurer may deduct, either from such loan value or from the proceeds of the loan, any existing indebtedness not already deducted in determining such cash surrender value, including any interest then accrued but not due, any unpaid balance of the premium for the current policy year, and interest on the loan to the end of the current policy year.” If an agent recommends a surrender and does not recommend using the proceeds to fund or purchase another annuity or life insurance policy, Fla. Stat. § 627.4553 requires written information first. That includes the estimated surrender charge and any forfeited death benefit.

Replacement rules and what counts as a switch

A switch that replaces one policy with another falls under Florida’s rules on misleading comparisons, twisting, and churning. Twisting means a misleading comparison used to push a surrender, loan, or replacement. Churning means using existing policy values to buy another policy from the same insurer without a clear benefit to you.

Florida law treats churning as an unfair and deceptive act. An insurer must also disclose, at the time of the offer, how existing values will be used. Where a policy’s values are used to buy a replacing or additional policy from the same insurer, the disclosure must show the premium and death benefit of the proposed policy and the date when the existing policy’s values will no longer cover its premiums.

A recommended switch is appropriate only when it is not misleading and the replacement rules are followed. Ask for every comparison in writing. Keep your current policy in force until the new one is issued and its terms are confirmed in writing.

Cost, age, health, and tax questions to answer before any change

Before any change, compare what you have paid with what the policy is worth today. Then ask whether a new policy would be issued at your current age and health.

Total premiums paid so far, compared with cash value and death benefit

The price of new coverage at your current age

Whether health questions and underwriting could limit issue

Health questions are required for a new policy, and issue may depend on insurability. A new policy written at an older age can be priced differently.

Tax questions matter too. Under 26 U.S.C. § 101, death benefits paid because of the insured’s death are generally excluded from gross income. Interest paid on proceeds left with the insurer is taxable. The IRS explains when proceeds may be taxable, based on the facts. Under 26 U.S.C. § 1035, certain exchanges of life insurance contracts recognize no gain or loss. A policy funded too quickly can fail the 7-pay test and become a modified endowment contract. Surrenders, lapses, and loans can each carry tax consequences, so review them with a CPA before you act.

How a coverage review works, step by step

A coverage review starts with your documents. It ends with written terms before any application is signed.

Gather documents. Bring the current policy, the latest annual statement, loan and surrender statements, and ownership and beneficiary papers.

Review the policy. The licensed insurance agent checks the death benefit, premium history, cash value, and loan position.

Set your goals. Decide what the coverage must still do, such as protecting a spouse, children, or a business obligation.

Compare options. Look at keeping the current policy, changing how premiums or loans are handled, or replacing it if the rules and facts support that step.

Get terms in writing. No application is signed until you have the written terms and a decision.

The timeline varies with the insurer, the documents you can provide, and underwriting. Any fee for the coverage review is disclosed in writing before work begins.

Who handles the review and how the firm is set up

Nischay Rawal, a licensed insurance agent, leads the insurance side of each coverage review. Florida law generally requires an insurance agent license to engage in the solicitation of insurance, which includes describing the benefits or terms of insurance coverage.

Insurance is offered by the licensed agent, separately from the accounting practice of NR CPAs & Business Advisors. If a CPA firm accepts a commission on a product, Fla.
