The business pays the premiums and is the beneficiary, so the payout goes to the company, not the employee’s family. This guide explains how the policy works, who owns it, and how tax rules apply. It is written for owners, partners, and finance or HR leads, including those who sponsor visa-holding staff.

What key person insurance on an H-1B employee is

Key person insurance is a policy a business applies for, owns, and pays for on the life of a key employee. The employee is the insured. The business is the beneficiary, so the death benefit helps the company absorb losses and cover replacement costs.

The Insurance Information Institute explains that key person coverage compensates a business for financial losses caused by the employee’s death or disability.

This coverage suits companies where one person’s loss would disrupt revenue, client relationships, or daily operations. That can include a business that sponsors an H-1B worker in a role the company depends on. The visa does not create the need for the policy. The business’s dependence on the person does.

Insurance on this page is offered by Nischay Rawal, a licensed insurance agent, separately from the firm’s accounting practice.

If you are looking into this for your company after a sudden loss or health scare involving a key employee on a work visa, you don't have to sort it out alone; our team can talk it through in a coverage review. A business that sponsors an H-1B worker often spends money on petitions, paperwork, and training for that role. A sudden death or serious illness creates the same continuity gap as it would for any key person.

Before buying, a business should be able to answer three questions:

Who is the key person, and what does that role do for revenue?

What would it cost to replace that person and train a successor?

Has the employee given written consent to the coverage?

The insurance contract and the visa paperwork are separate documents. This coverage review covers the insurance and tax side. Immigration questions fall outside its scope.

What the policy covers and what it does not

A key person life policy pays a death benefit to the business when the insured dies while the policy is in force. Check these items in the policy before you buy:

The insured’s name, the owner, and the beneficiary

The face amount, which is the amount payable at death

The policy type, either term or whole life

The premium payment period, and any change in premiums or face amount

The insurer’s name and the policy form number

Exclusions and limitations in the policy form

Renewability, cancellability, and any age-based change

The insurer reviews health information before issuing the policy. Health questions are required, and issue depends on insurability.

Disability coverage is a separate product. Confirm whether the policy pays only on death.

Florida law requires life policies to become incontestable once they have been in force during the insured’s lifetime for two years from issue, except for nonpayment of premiums and, at the insurer’s option, provisions on disability benefits and additional accidental death insurance (Fla. Stat. § 627.455). Florida law also requires a grace period of at least 30 days for premiums after the first (Fla. Stat. § 627.453).

Who owns the policy, who pays, and how it is taxed

The business usually owns and pays for the policy, and it usually receives the death benefit. Florida law lets a business insure a key person only with that person’s written consent, given before the policy is bought (Fla. Stat. § 627.404). The business may not retaliate or take adverse action against a key employee or key person who does not consent to the insurance.

Under federal law, life insurance death proceeds are generally not taxable income (IRC § 101). The IRS guidance on life insurance proceeds says interest earned on those proceeds is taxable.

Premiums are generally not deductible when the business is the beneficiary (IRC § 264).

Section 101(j) generally limits the tax exclusion for employer-owned contracts to the premiums and other amounts the business paid, but the section has exceptions that apply only if the notice and consent requirements are met, for example when the amount is paid to the insured’s family member, designated beneficiary, a trust for them, or the insured’s estate (IRC § 101). Residency can change the tax picture. Businesses that own employer-owned contracts issued after the date of the enactment of this section must also file a yearly return and keep consent records (IRC § 6039I).

Tax results depend on the policy, the business’s structure, and the facts of the case. The firm’s accounting services are separate from insurance sales.

How much coverage to buy and how many key people to insure

Most businesses size coverage from the money they would lose, or need, if the person were gone. Three items usually matter most: revenue lost while the business recovers or searches, the cost of recruiting and training a replacement, and cash needed for debts tied to the role.

Here is an example with labeled assumptions. Suppose a company expects $120,000 in lost profit over six months, plus $30,000 to recruit and train a replacement. A planning figure would start near $150,000. These are example numbers, not benchmarks.

Many businesses insure more than one person. Deciding who counts as key depends on the person’s role and authority. The coverage review works through those questions with the business’s financial records. The result is a planning figure, not a valuation of the business.

How the process works, step by step

The process moves from a coverage review to underwriting and then to a delivered policy. Here is the usual sequence:

Coverage review: The firm reviews the key employee’s role and the business’s needs.

Gather information: Collect the employee’s role, age, residence and travel plans, health history, financial statements, and any existing policy on the same person.

Compare options: Review the named insurer, policy form number, premiums, limits, and exclusions.

Apply: Obtain the employee’s written consent and answer underwriting questions. Underwriting time varies.

Review the policy: Compare the delivered policy with the options you reviewed.

If the business already has a policy on this employee, replacement rules apply. Compare the old and new policies before any change.

If the employee lives or travels abroad, the insurer’s underwriting rules matter, and the insured’s status under section 101(j)(2) can affect whether the exclusion applies. The total timeline depends on the facts of each case.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Common questions about key person insurance on an H-1B employee
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a business buy key person insurance on an H-1B employee?

Generally yes, if the business has an insurable interest and the employee consents in writing before the policy is bought (Fla.
