Generally, yes. Citizenship alone rarely decides whether a designation works. The policy owner, the insured, the insurable interest and the insurer’s payment rules matter more.

Short answer: can a non-US citizen be named as a beneficiary?

A non-US citizen can generally be named as a life insurance beneficiary. Each insurer sets its own documentation rules, so ask for the full list before you apply.

Insurable interest is the key test when one person buys coverage on another person’s life. Under Fla. Stat. § 627.404, a person has an insurable interest if he or she expects a substantial financial advantage from the other person’s continued life, and would suffer a substantial financial loss from that person’s death. The test turns on relationship and money at risk, not citizenship. Separately, an individual also has an insurable interest in a person closely related by blood or by law, such as a spouse or a parent, in whom he or she has a substantial interest engendered by love and affection. Under Fla. Stat. § 627.404, an individual party to a contract for the purchase or sale of an interest in any business entity has an insurable interest in the life of each other party to such contract, for the purpose of such contract only. It must exist when the contract is made, not afterward.

For business owners, a company can insure an owner or key person only with that person’s written consent, obtained before the policy is bought. This matters for key person and buy-sell arrangements.

Young children usually can’t receive a death benefit directly. Many families name an adult custodian or a trust instead. Policies bought before a move abroad may still be valid, but they should be reviewed against current insurer rules.

Paying a beneficiary who lives outside the US

Insurers pay a beneficiary abroad after they verify identity and confirm a valid payment method. Check the payment options in your policy before you name someone overseas.

When a policy pays a lump sum at death, the payment must include interest. Under Fla. Stat. § 627.4615, that interest runs from the date the insurer receives written due proof of death.

Federal income tax works like this in general. Under 26 U.S.C. § 101(a), life insurance death benefits are generally excluded from gross income. The IRS notes that interest paid on the proceeds is taxed.

Estate tax depends on whose life is insured and who owns the policy. Under 26 U.S.C. § 2105(a), proceeds on a nonresident non-citizen’s life are not treated as US property.

Because the answer depends on the facts, a CPA review of cash flow and estate effects is worth doing before you finalize a designation. Keep the beneficiary’s legal name, relationship, address and contact details consistent with the insurer’s file. Mismatched details can slow a claim.

How a coverage review works

A coverage review is our first meeting on your policy. It follows four steps.

Send the details. Share the insured, the owner, the current beneficiaries and the intended beneficiary’s country of residence.

Review the paperwork. We review the existing designation and policy documents, then list what the insurer will need.

Compare the options. Nischay Rawal, a licensed insurance agent, explains primary and contingent choices and the forms for any change.

Add the tax view. Where an estate, gift or cross-border tax question arises, the CPA side reviews it. Insurance is offered by the licensed agent, separately from the accounting practice.

Changes go through the insurer’s own forms. Timing depends on the insurer’s processing and the documents it requests.
