How long it takes depends on the facts of the policy and the claim, so the insurer’s review and the completeness of the paperwork largely set the pace.

The Short Answer: How Long Does Key Person Life Insurance Claim Take?

A key person claim usually takes as long as the insurer needs to review a complete claim package. The clock generally starts when that package arrives, not on the date of death. The business owns the policy and is named as beneficiary, so the business receives the death benefit. Key person insurance protects a business against financial losses from the death of a key employee, as the Insurance Information Institute explains. A complete file gives the insurer nothing to ask for, so it has fewer reasons to pause. That is the part of the timeline you control most. Knowing who owns the policy and who is named as beneficiary is the first step. A CPA’s view of ownership helps here, because the same facts also shape the tax result later.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

What Starts the Claim Clock

The claim starts when the insurer receives a notice of claim and proof of death. A notice of claim is the insurer’s form that tells it a death has occurred and a benefit is requested. Proof of death is usually an official certified death certificate. An incomplete package usually pauses review until the missing item arrives. Common gaps include an unsigned form, a missing policy number, or unclear beneficiary details.

The business, as owner and beneficiary, usually files the claim. The insurer’s forms set the exact list, so ask the insurer which items it needs in writing. The agent of record can help identify those requirements. Start gathering them early, before anyone feels rushed. Write down the date the insurer receives the complete package, and keep a copy of whatever proves it was sent.

The Stages From Notice of Death to Payment

Most insurers move a claim through the same general steps, though they name them differently. First, the insurer receives notice. Next, it acknowledges the claim and reviews the documents. It may then verify certain facts, make a decision, and arrange payment. Each stage has its own pace. A claim can clear the paperwork quickly and still wait on one verification step.

Florida law adds a rule about interest. When a policy pays its proceeds in one lump sum at the insured’s death, Fla. Stat. § 627.4615 requires the payment to include interest. The interest runs from the date the insurer receives written due proof of death. The annual rate must be at least the Moody’s Corporate Bond Yield Average-Monthly Average Corporate as of the day the claim was received; if the method of calculating that index has been substantially changed since January 1, 1993, the rate must not be less than 8 percent. Ask the insurer for a written status note at each stage. A short note makes it easier to spot a step that has stalled.

Documents a Business Should Gather Early

Gather the claim paperwork before you file. Common items include:

The policy number and a copy of the policy.

A certified death certificate.

The insurer’s claim form, completed and signed by an authorized officer of the business.

Proof that the business has authority to file the claim.

Check that names, dates, and owner and beneficiary designations match on every form. A small mismatch often sends a form back for correction, and that adds time. Keep a dated file of every submission and every insurer reply. That file makes the timeline easy to follow. It also gives you a record if a question comes up later.

Have questions about what happened?

Ask our team directly. Before the policy reaches that point, the insurer can still question the application if a death occurs. That is the window where a claim can take longer.

The review looks at whether the application information was accurate. It does not judge the employee’s character. If the insurer asks for more information, answer each question fully and in writing. The policy contract sets the specific terms, so read the contestability language in your own policy before a claim is filed.

Who Receives the Money and How the Business Can Use It

The death benefit usually goes to the business as beneficiary, and the business decides how to use it. Many owners use the money to cover lost revenue, recruit a replacement, or fund a buy-sell agreement. Federal tax law generally excludes death proceeds from income. Under 26 U.S.C. § 101(a), amounts received under a life insurance contract are not gross income when paid because of the insured’s death, subject to listed exceptions.

For a transfer for a valuable consideration of a life insurance contract or any interest therein, the excluded amount can’t exceed the actual value of that consideration plus the premiums and other amounts subsequently paid by the transferee, unless the listed exceptions apply. That rule comes from IRC § 101 as well. Interest paid on the proceeds is taxable when the amount is held under an agreement to pay interest thereon, according to the IRS FAQ on life insurance proceeds.

Beneficiary choice also matters under Florida law. Fla. Stat. § 222.13 reads: “Notwithstanding the foregoing, whenever the insurance, by designation or otherwise, is payable to the insured or to the insured’s estate or to his or her executors, administrators, or assigns, the insurance proceeds shall become a part of the insured’s estate for all purposes and shall be administered by the personal representative of the estate of the insured in accordance with the probate laws of the state in like manner as other assets of the insured’s estate.” That is why the named beneficiary should be checked before a claim is needed. A business that leaves a key employee also faces different policy questions than one dealing with a death, which is covered in our separate guidance on key employee departures.

Planning for Delays and Taking the Next Step

Common reasons a claim slows down include incomplete forms, a contestability review, unclear beneficiary records, a policy that was replaced or changed, and a required verification step. Keep the agent’s contact details and the insurer’s claim number in one place. Everyone who handles the file should be able to reach them.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long does key person life insurance claim take to pay?

There is no set number of days.
