Yes. In Florida, every life insurance contract must give the insured a grace period of at least 30 days to pay any premium after the first one. The policy stays in force during that window. If the premium is still unpaid when the window closes, the policy can lapse.

This page explains how the grace period works, how late a premium can be, and what a lapse can mean. It also separates the grace period from the contestability period, which is a different clock. The information below is general in nature. During that window, you can still pay the premium and keep the policy in force. A missed due date is not the same as a cancellation.

Florida law requires the grace period to be part of the contract. Fla. Stat. § 627.453 sets the minimum. Your policy and premium notice state the exact terms your insurer uses.

Think of the grace period as a timing buffer. It does not erase what you owe. The premium is still due, and the insurer may charge interest on the late amount. The sections below explain how that works.

How late can I pay my life insurance premium?

Florida sets the minimum at 30 days for any premium after the first. Your policy may allow a longer window. Check the premium notice and the policy for the exact end date.

Billing frequency matters. Annual, quarterly, and monthly premiums each have their own due dates and notices. Count from the due date printed on the notice, not from the day you opened the letter.

If you pay by automatic debit or through a licensed agent, your bank or agent records may show a different date than the letter. Compare them before you assume you have time. A payment sent late in the window may take several days to post. Ask the insurer when it treats a payment as received.

Is coverage still in force during the grace period?

Yes. Florida law says the policy continues in force during the grace period. Coverage stays active while the overdue premium is open and the grace period has not ended.

What if the insured dies during that window? If the policy becomes a claim during the grace period, before the overdue premium is paid, the overdue premium plus interest of up to 8 percent per year may be deducted in any settlement under the policy. The insurer may charge that interest at its option, at not more than 8 percent per year.

This matters for families and for businesses that pay the premium. The amount owed can reduce what is paid. The exact effect depends on the policy. Ask the insurer to show the calculation in writing.

What happens if the grace period expires

Coverage may end at that point, and the policy’s own terms, along with any applicable law, set what comes next.

Florida adds a notice step for older insureds. Under Florida law, a life insurance contract issued or issued for delivery in this state on or after October 1, 1997, covering a natural person 64 years of age or older, which has been in force for at least 1 year, may not be lapsed for nonpayment of premium unless, after expiration of the grace period, and at least 21 days before the effective date of any such lapse, the insurer has mailed a notification of the impending lapse in coverage to the policyowner (Fla. Stat. § 627.4555). The notice goes to the policyowner and to any secondary addressee named in writing. Florida law also provides that this lapse notice requirement does not apply to life insurance contracts under which premiums are payable monthly or more frequently and are regularly collected by a licensed agent or paid by credit card or any preauthorized check processing or automatic debit service of a financial institution (Fla. Stat. § 627.4555).

Term coverage generally ends at a lapse, with no cash value to fall back on. Whole life with cash value may offer options written in the policy, such as reduced paid-up or extended term coverage. Read which options apply.

Watch policy loans too. Under Fla. Stat. § 627.458, a policy may provide that if interest on any indebtedness is not paid when due, such interest is added to the existing indebtedness. If the debt equals or exceeds the loan value, the policy may terminate, but only after at least 30 days’ notice.

Have questions about what happened?

Ask our team directly. The insurer sets the conditions. Common conditions include paying the overdue premiums, often with interest, and providing evidence of insurability, which may include health questions.

Reinstatement is not automatic. It depends on the policy and on the insurer’s review. Ask the insurer for the reinstatement deadline in writing. Note it on the calendar.

Act early. The longer a lapse lasts, the more the options may narrow. For a business key person policy, put the deadline in the company’s records next to the premium entry. A new policy is a new contract, and its terms can differ from the old one.

Contestability period vs. grace period: what is incontestability?

The contestability period is a separate clock. It runs for two years from the policy’s issue date.

Keep the two ideas apart. The grace period asks whether a late premium was paid in time. Incontestability asks whether the application was accurate and whether the policy can still be challenged on that basis. Missing a premium is a payment question, not an application question.

What life insurance does not expire?

Permanent life insurance, such as whole life, is built to last for the insured’s life. It stays in force as long as the policy is kept active. Term life insurance runs for a set period and ends when that period ends. The Florida Department of Financial Services consumer guide explains these types of coverage.

Permanent coverage can still lapse for nonpayment. So the grace period and the premium schedule still matter. Federal tax law also sets a definition a contract must meet to count as life insurance.

Grace periods in key person and buy-sell policies

A late premium on a business-owned policy can affect more than one owner. Key person insurance compensates a business for financial losses caused by the death or disability of a key employee, according to the Insurance Information Institute.

Track each premium payment, its due date, and its proof of payment in the company records. A late payment that no one noticed is harder to fix later.

For buy-sell coverage, partners should know who receives premium notices and who can act during the grace period. Under 26 U.S.C. § 101, death benefits are generally excluded from gross income, but for an employer-owned life insurance contract the exclusion can be limited to the premiums and other amounts the policyholder paid unless the section’s conditions, such as informing the employee in writing, are met. A transfer for valuable consideration can limit that exclusion, so ownership changes need review.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is there a grace period for life insurance in Florida?

Yes. Stat. 627.4555, a life insurance policy issued or issued for delivery in Florida on or after October 1, 1997, that covers a person age 64 or older and has been in force for at least 1 year may not be lapsed for nonpayment of premium unless, after the grace period ends and at least 21 days before the lapse would take effect, the insurer has mailed a notice of the impending lapse to the policyowner and to any secondary addressee the policyowner has designated in writing. This rule does not apply when premiums are payable monthly or more often and are regularly collected by a licensed agent or paid by credit card, preauthorized check processing or an automatic debit service of a financial institution. If a late-premium notice has you worried, whether it's a parent's policy or a company policy you co-own, you don't have to sort it out alone. Nischay Rawal, a licensed insurance agent, can review the policy, the notice, and your next steps with you. You can request a coverage review with NR CPAs & Business Advisors. Insurance is offered by the licensed agent, separately from the firm's accounting practice."}}], "description": "Explains whether life insurance has a grace period, how late a premium can be paid, whether coverage stays in force during the window, what happens after it expires, how reinstatement works, and how the grace period differs from the contestability period.", "isAccessibleForFree": true, "mentions": [{"@type": "Thing", "name": "Whole life insurance", "sameAs": "https://en.wikipedia.org/wiki/Whole_life_insurance"}, {"@type": "Thing", "name": "Key person insurance", "sameAs": "https://en.wikipedia.org/wiki/Key_person_insurance"}, {"@type": "Thing", "name": "Buy-sell agreement", "sameAs": "https://en.wikipedia.org/wiki/Buy–sell_agreement"}, {"@type": "Thing", "name": "Cash value", "sameAs": "https://en.wikipedia.org/wiki/Cash_value"}, {"@type": "Thing", "name": "Insurance policy", "sameAs": "https://en.wikipedia.org/wiki/Insurance_policy"}, {"@type": "Thing", "name": "Certified Public Accountant", "sameAs": "https://en.wikipedia.org/wiki/Certified_Public_Accountant"}, {"@type": "Thing", "name": "Insurance broker", "sameAs": "https://en.wikipedia.org/wiki/Insurance_broker"}], "reviewedBy": {"@type": "Person", "name": "Erika Trinidad", "jobTitle": "Accountant", "worksFor": {"@type": "Organization", "@id": "https://nrcpas.com/life-insurance-guides/#organization", "name": "NR CPAs & Business Advisors", "url": "https://nrcpas.com/"}}, "image": "https://nrcpas.com/life-insurance-guides/wp-content/uploads/2026/10/documents-a-pen-and-a-calculator-on-a-desk-beside-a-window-s-photo.jpg", "mainEntityOfPage": "https://nrcpas.com/life-insurance-guides/key-person-insurance/is-there-a-grace-period-for-life-insurance/", "@type": ["Article", "FAQPage"]}, {"@context": "https://schema.org", "@type": "BreadcrumbList", "itemListElement": [{"@type": "ListItem", "position": 1, "name": "Home", "item": "https://nrcpas.com/"}, {"@type": "ListItem", "position": 2, "name": "Key Person Insurance", "item": "https://nrcpas.com/life-insurance-guides/key-person-insurance/"}, {"@type": "ListItem", "position": 3, "name": "Is There A Grace Period For Life Insurance", "item": "https://nrcpas.com/life-insurance-guides/key-person-insurance/is-there-a-grace-period-for-life-insurance/"}]}]
Florida life insurance policies must give at least 30 days to pay a late premium.
