Usually, you can borrow part of the policy’s cash value, up to the loan value set by the policy and the insurer’s loan terms. You don’t borrow against the full death benefit. The insurer lends the money, and the policy itself is the security.

This guide explains what sets that number, what a loan does to the death benefit, and what to check before you borrow. Whole or permanent life insurance gives lifetime coverage and includes a cash-value feature. Florida’s loan rule also excludes term policies and term insurance riders.

Whole life is designed to build cash value over time. The Oregon Division of Financial Regulation describes permanent life insurance as having a cash-value account that can be borrowed against or withdrawn. The premiums you pay, your policy’s age, and its design all affect how cash value builds.

Don’t assume a set pace. Your policy’s numbers depend on its own contract. Check your annual statement or contract for the current cash value and loan value. Those two figures answer the question for your policy, not for a general example.

Guaranteed values, non-guaranteed values and dividends

Some numbers in your policy are guaranteed by the contract. Others are not. Keep the two apart when you plan a loan, and give each the same attention.

Guaranteed values are written into the contract. Even these depend on your loans, unpaid premiums, and the policy’s terms. Non-guaranteed values can change because the insurer sets them.

Dividends are the main example of a non-guaranteed value. Where a policy pays dividends, the insurer sets them, and they are not guaranteed. A dividend is not a promised return, and it is not a share of the insurer’s profits. Don’t count on dividends to repay a loan.

Ask the insurer for both sets of figures in writing before you borrow. For the trade-offs of permanent coverage, read the downside of permanent life insurance.

How a whole life policy loan works

A policy loan is a loan from the insurer, backed by your policy. The answer to how much you can borrow from whole life insurance also depends on what the loan costs over time. Interest accrues at the rate your policy contract sets.

Repaying the loan is optional under the policy’s terms. But any unpaid balance and interest reduce what beneficiaries receive. The debt comes out of the death benefit.

Florida law covers unpaid interest. Under Fla. Stat. § 627.458, a policy may also provide that, if interest on any indebtedness is not paid when due, the unpaid interest is added to the existing indebtedness and bears interest at the same rate. If the total indebtedness, including interest due or accrued, equals or exceeds the loan value, the policy may terminate if its terms provide for that, but only after the insurer has mailed at least 30 days’ notice to the last known address of the insured or policyowner and of any assignee of record, at the insurer’s home office. That cannot happen until the insurer has mailed at least 30 days’ notice to you and any assignee of record.

Premiums matter too. Under Fla. Stat. § 627.453, a policy must allow a grace period of at least 30 days to pay a premium after the first. The insurer may charge interest of up to 8 percent per year for the days of grace.

Have questions about what happened?

Ask our team directly. Still, what you do with the loan can raise replacement questions. Florida treats churning as an unfair or deceptive practice. Under Florida’s unfair insurance trade practices law, churning means using the values of an existing life insurance policy or annuity contract (for example its cash value, loan value or dividend values, including values in any riders) to buy another policy or contract from the same insurer in order to earn more premiums, fees, commissions or other compensation. This applies when there is no objectively reasonable basis to believe the policyholder will receive an actual and demonstrable benefit, when it is done in a fraudulent, deceptive or misleading way, or when the applicant is not told that the existing policy’s values will be reduced, forfeited or used for the new purchase.

The test is whether there is an objectively reasonable basis for believing the change gives you an actual and demonstrable benefit. If someone suggests using a loan to buy a new policy from the same company, ask for the benefit in writing. Any comparison used to push a change must be accurate and not misleading.

A larger loan may raise replacement questions, so review the change before you sign anything.

Can you cancel or surrender whole life insurance instead of borrowing?

Surrender ends the coverage and pays the surrender value under the contract. A loan keeps the policy in force while the debt stays within its terms. Florida’s agent-disclosure law defines surrender as a voluntary request for the current cash surrender value. It leaves out policy loans and lapses for nonpayment. See Fla. Stat. § 627.4553.

If an agent recommends surrendering an annuity or life insurance policy with a cash value, and does not recommend using the proceeds to fund or purchase another annuity or life insurance policy, the agent must give written information before the surrender is executed. That information includes, but is not limited to, the estimated surrender charge, the loss of any minimum interest rate guarantees, the possibility of tax consequences, the amount of any forfeited death benefit, and a description of any other investment performance guarantees being forfeited.

Federal definitions also treat charges and loans differently. Under IRC § 7702, surrender charges reduce net surrender value, while policy loans are not counted in that figure.

See Fla. Stat. § 627.4555. The right choice depends on your family’s needs and your cash flow.

Borrowing from key person and business-owned whole life policies

A business may own a key person or buy-sell whole life policy. The same cash value and loan rules apply under the policy contract. Business ownership adds a tax layer, though.

Under IRC § 264, no deduction is allowed for interest on debt tied to life insurance policies the taxpayer owns, covering an individual. Under IRC § 264(e)(1), the key person exception to the interest disallowance in § 264(a)(4) applies to interest on indebtedness on policies covering a key person only to the extent that the aggregate indebtedness on policies covering that individual does not exceed $50,000; a key person means an officer or 20-percent owner, not every key employee, the number of individuals who may be treated as key persons is capped under § 264(e)(3), and the interest rate cap in § 264(e)(2) also applies. Ask a CPA how that rule fits your facts before you assume any deduction.

Funding speed also matters.
