There’s no single answer. The time depends on how quickly the claim is filed, what the insurer must verify, and whether the policy’s status or age raises questions. Some steps are in your hands. Others are in the insurer’s.

NR CPAs & Business Advisors is a Miami CPA firm that helps business owners choose and buy life insurance, including key person coverage. This page is for Florida owners in Miami, Fort Lauderdale, West Palm Beach, Orlando, Tampa and Jacksonville. The goal is to help you prepare papers and cash before a claim, not after.

What a Key Person Insurance Payout Is and Who Receives It

In a typical key person arrangement, the business owns the policy and is the beneficiary. The payout goes to the business, not directly to the insured’s family.

Key person life insurance helps a business recover financial losses caused by the death or disability of a key employee, according to the Insurance Information Institute. The business pays the premiums and receives the proceeds. The insured can be an owner, an executive or an employee whose work the business relies on.

The death benefit may be paid in a single sum or otherwise, under the policy’s terms. It is not a return on investment, and it is not a share of profit. The policy sets the amount, not how well the business performs.

For employer-owned life insurance, IRC § 6039I(a)(5) requires the return to show that the policyholder has a valid consent for each insured employee (or the number of insured employees for whom such consent was not obtained). Consent rules for other owner or key person policies depend on the contract and the applicable rules, so review them with your coverage review before any policy is bought. Keep that consent on file.

If your business depends on one owner or employee, and you're unsure whether the policy and claim file are ready, schedule a coverage review with our team. Each stage has its own timing, and that timing varies with each claim.

1. Notice. The business or family tells the insurer about the death. The business controls how fast this happens.

2. Claim forms and proof. The insurer sends its forms, and the business returns them with the required records. Florida law adds interest to this step. Under Fla. Stat. § 627.4615, a lump-sum death payment must include interest from the day the insurer receives written due proof of death.

3. Review. The insurer checks the death record, the policy status, the application and the payee.

4. Decision. The insurer decides the claim under the policy’s terms.

5. Payment. The insurer pays the business as beneficiary.

Steps one and two depend mostly on the business and family. Steps three and four depend mostly on the insurer. Plan around these steps, not around a fixed number of days.

Documents to Gather Before a Claim Is Filed

Keeping papers ready now can prevent extra requests later. Missing or mismatched records add back-and-forth steps, and each step can extend the timeline.

Gather these items before you need them:

A certified death certificate.

The policy number and the insurer’s claim form.

Proof that the business is the beneficiary.

Premium payment records.

Ownership documents for the policy.

A corporate resolution authorizing the coverage.

Proof of the insured’s date of birth.

Age matters. Under Fla. Stat. § 627.456, if the age or sex of the insured, or of any other individual considered in determining the premium or benefit, was misstated, the benefit becomes what the premium would have bought at the correct age or sex, using the insurer’s rate at the date of issue. Check that the age on the application matches the records now.

Keep one current file. Store policy copies, premium records, ownership papers and the corporate resolution together. Update the file whenever the policy, its ownership or its beneficiary changes.

Factors That Can Lengthen the Payout Timeline

The main timing factors are the contestability period, the policy’s status and any questions about the application. A claim that falls within these periods can take longer to review.

Contestability. Under Fla. Stat. § 627.455, a Florida life policy must become incontestable after it has been in force during the insured’s lifetime for two years from its issue date. The rule does not cover nonpayment of premiums, and at the insurer’s option it may also exclude provisions relative to benefits in event of disability and provisions which grant additional insurance specifically against death by accident or accidental means.

Policy status. Under Fla. Stat. § 627.453, a policy must allow a grace period of at least 30 days for a late premium. If the insured dies during that grace period, the overdue premium, with interest up to 8 percent a year, may be deducted from the settlement. If the policy lapsed, the insurer checks whether coverage was in force on the date of death.

Other factors. An older policy, a change in ownership or beneficiary, or a death outside the United States can add review steps. Each of these adds steps. None of them decides the claim by itself.

Why Insurers Take Time to Review Claims

Insurers take time to confirm facts before they pay. A longer review is not the same as a denial.

The review usually checks four things. It confirms the death record matches the insured and the policy. It confirms the policy was in force. It compares the application with the records. It confirms who the payee is.

Florida law sets rules on interest and contestability, and the statutes cited above govern those points. The insurer’s own steps for your claim appear in the policy and in its claim letters. Ask the insurer for its written timeline, and keep every letter it sends.

When the insurer asks questions, answer them in writing and keep copies. Clear, complete answers reduce the back-and-forth that slows a file. A review is not a denial. The decision depends on the facts.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Tax Treatment of Key Person Insurance Proceeds

Premiums are generally not deductible when the business is the beneficiary. Death benefits are generally excluded from gross income, with exceptions.

Under IRC § 264, no deduction is allowed for premiums on a life policy if the taxpayer is directly or indirectly a beneficiary under the policy. Under IRC § 101, amounts paid by reason of the insured’s death are generally excluded from gross income.

Some exceptions matter. For employer-owned contracts, the amount an applicable policyholder may exclude generally may not exceed the premiums and other amounts it paid, though exceptions apply, including for amounts paid to the insured’s heirs. Employer-owned policyholders that own contracts issued after the date of the enactment of this section (August 17, 2006) must file yearly returns under IRC § 6039I, and each applicable policyholder owning employer-owned life insurance contracts during any year must keep the records needed to determine compliance.

Confirm how these rules apply to your entity before you rely on any figure. Your tax advisor can review your facts.

Planning Cash Flow While a Claim Is Pending

Plan for the gap between the loss and the payment before a claim happens. Payroll, rent, vendors and loan payments keep coming while the claim is open.

Start with a reserve account sized to your known short-term costs. List each obligation, its monthly amount and who approves payments. Name one person to handle the claim with the insurer, and write that role down.

Make a list of lenders, partners and key clients who need notice. Decide now how and when you will tell each one.

Some owners weigh bridge financing against insurance proceeds. Compare each option on your own numbers, with your tax advisor. No single funding answer fits every business.

Key Person Insurance Questions Businesses Ask About Payout Timing

No single timeline applies to every claim.
