Not automatically. A move to India does not cancel key person coverage on its own. The policy’s terms, the insurer’s rules and the facts of the death or disability decide whether a claim pays.

Three areas need a check first. The first is residence and territory wording, which says where coverage applies. The second is exclusions, the lines that can limit a payout in certain situations. The third is the insurer’s notice rules for a change of residence.

Check who owns the policy, too. In most key person cases, the business owns the policy and receives the death benefit. The owner’s family usually does not. That shapes who files the claim from abroad and who signs the paperwork.

Start with the policy form itself, not a summary. A summary can leave out the wording that controls a claim.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

What key person insurance pays and who receives it

Key person insurance is a life policy that a business owns on someone whose work or knowledge the company depends on. The death benefit is paid to the business. The Insurance Information Institute explains that key person life or disability coverage compensates a business for financial losses caused by a key employee’s death or disability.

That payment is company money. It is not a personal inheritance. The proceeds belong in the business’s accounts, which is where a CPA review of the policy begins.

Fla. Under Fla. Stat. § 627.404, a person may not buy insurance on another person’s life unless the benefits are payable to the insured or to a person with an insurable interest at the time the contract is made. See Fla. Stat. § 627.404.

Key person coverage is a different contract from the owner’s personal term or whole life policy. Each policy has its own owner, beneficiary and terms. Review them separately so one does not get confused with the other.

Does life insurance pay out if you die abroad?

Whether a claim pays after a death abroad depends on the policy contract. The country alone does not settle the question. Check whether the policy limits coverage by residence, travel or territory, and whether a death outside the United States is handled differently.

Expect more paperwork when a death happens overseas. The insurer typically asks for death records from the country where the death occurred. Those records can take time to obtain, so a claim may run longer than one filed at home.

Florida’s rule on interest helps here. When a policy pays a lump sum at the insured’s death, the payment must include interest from the date the insurer receives written due proof of death. The rate must be at least the Moody’s Corporate Bond Yield Average, as stated in Fla. Stat. § 627.4615.

Read the wording of the policy itself. A summary may leave out the clause that controls the claim.

Exclusions to read before you move: war, military service and early-policy rules

Exclusions are the clauses most likely to change a claim after a move. Read them before you change residence, not after a loss. Many policies exclude deaths tied to acts of war or military service. If you plan to live in or travel to a region with political or military unrest, read those lines closely. The exact wording varies by insurer.

Many policies also include a suicide provision that applies during the early years of the policy. The length and terms differ by policy, so check the form the business holds.

Florida’s incontestability rule matters here too. Under Fla. Stat. § 627.455, a life policy becomes incontestable after it has been in force for 2 years from its date of issue, with listed exceptions. Fla. Stat. § 627.455 reads: “Every insurance contract shall provide that the policy shall be incontestable after it has been in force during the lifetime of the insured for a period of 2 years from its date of issue except for nonpayment of premiums and except, at the option of the insurer, as to provisions relative to benefits in event of disability and as to provisions which grant additional insurance specifically against death by accident or accidental means.” But Fla. Stat. § 627.463 says incontestability does not stop the insurer from relying on policy provisions that exclude or restrict coverage. A two-year limit on contesting validity does not remove an exclusion.

Questions the insurer may ask about a move to India

Applications and policy changes often ask where the insured lives and how long they plan to stay abroad. Answer these questions accurately and in writing. A wrong or outdated answer can cause a dispute when a claim is filed.

Tell the insurer about a planned move before it takes effect. Do not wait until after you leave. Ask in writing how the insurer treats the change, whether coverage continues unchanged, and whether any notice or form is needed.

Accuracy protects both sides. It protects the business, which relies on the policy. It also protects the owner, whose family or business partners may depend on the outcome. The contestability rules above show why an early mistake can matter. Keep copies of every notice you send and every reply you receive.

Payout timing, foreign paperwork and reporting proceeds to the business

A claim filed from India may need more documents and more time. Plan for certified death records, translated documents where required, and proof that the business has the authority to file. Ask the insurer for its exact document list before you move, not after.

Plan cash flow with a possible delay in mind. The business may still need to cover payroll, debt and other costs while a claim is pending. A delay does not mean a claim has failed, but it can strain a company with little cash on hand.

Tax treatment follows federal rules. Under 26 U.S.C. § 101(a), amounts paid by reason of the insured’s death are generally not gross income, subject to listed exceptions.

Under 26 U.S.C. § 264, no deduction is allowed for premiums on a life insurance policy if the taxpayer is directly or indirectly a beneficiary under it. A business that is the beneficiary of its own key person policy generally cannot deduct those premiums. Applicable policyholders that own employer-owned life insurance contracts issued after the date this section was enacted (Aug. 17, 2006) must file a yearly federal return under IRC § 6039I. Whether a given policy is employer-owned depends on the facts.

Have questions about what happened?

Ask our team directly. It has its own definition of disability and its own waiting period. Death coverage and disability coverage can work very differently within the same policy.

A disability claim filed from abroad can raise different questions. The insurer may ask for medical evidence from doctors outside the United States. It may also ask whether the insured can still do the work the business relies on. The policy wording controls both questions.

Check the disability terms before you move. Ask the insurer how it reviews medical records from another country. Confirm whether the policy pays only after a set waiting period, and how long that period runs. Do not assume the death benefit terms also cover disability.

Three ways to put a number on the coverage before you move

Three common methods help size key person coverage: multiple of compensation, contribution to profit and replacement cost. Use them as a planning check, not as a sales figure.

A multiple of compensation starts from the insured person’s pay. It is a common starting point. Test the result against the business’s other numbers, such as debt, payroll and the cost of losing a major client.

Contribution to profit looks at the profit the person helps create. It asks how much profit the business would lose without that person’s work. This method can support a different amount than pay alone.

Replacement cost totals what it would cost to hire and train someone to do the person’s work. Include the time a new hire needs to reach full productivity. Add these costs together to estimate the loss.

Compare the three results before you change any policy. The right amount depends on your business’s facts, and no single method fits every company.

How NR CPAs & Business Advisors reviews a relocation plan

Insurance is offered by Nischay Rawal, a licensed insurance agent, separately from the accounting and tax practice of NR CPAs & Business Advisors. Under Fla. Stat. § 626.9531, when soliciting or selling insurance products, an agent must clearly indicate to prospective insureds that they are acting as insurance agents with regard to insurance products and identified insurers, or other risk bearing entities authorized and approved to do business in Florida.

A coverage review follows a clear order. First, gather the current policy form, not only the summary. Second, confirm the owner’s planned move date and the length of the stay. Third, check the residence, territory, exclusion and notice wording. Fourth, compare the coverage amount with the business’s numbers, using the methods above.

The NAIC Life Insurance Buyer’s Guide covers questions to ask before buying coverage. It makes a useful checklist for the review.

The CPA view comes next. It covers how proceeds, premiums and any buy-sell or key person structure affect the business’s tax and cash flow. That view is given within the accounting practice.

Talk to us before the move date

If you plan to move to India while your company still holds key person coverage, the time to check is before the move date. Picture an owner with a set relocation date, a company that depends on that owner, and a policy form nobody has reread since it was issued. That owner needs to know whether a claim would still pay.

Contact NR CPAs & Business Advisors to set up a coverage review of the current policy.
