A death overseas does not decide the claim by itself. This page explains what to check in the policy file and why each item matters.

The Short Answer: It Depends on the Policy Terms

Whether the death benefit is paid turns on three things: the policy’s wording, whether premiums kept the policy in force, and the documents the insurer asks for. A key person policy is a contract between the policy owner and the named insurer. That contract controls the outcome. Where the insured lived or died is one fact among several, not the whole answer.

The Insurance Information Institute describes key person life insurance as protection that compensates a business for financial losses when a key employee dies or becomes disabled (Insurance Information Institute). The benefit goes to the business that bought the policy. So the real question is how that policy is written. Many business owners feel rushed when this happens. Most of the answer sits in documents you can gather now: the policy form, the premium notices and the beneficiary page.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Who Is the Owner, Insured and Beneficiary?

The business is usually the owner and beneficiary, so the company, not the family, typically receives the proceeds. The owner controls the policy. The insured is the key person whose life is covered. The beneficiary receives the death benefit under the policy’s terms.

Florida law lets a business insure a key person only with that person’s written consent. A business entity has an insurable interest in key persons if their written consent is obtained before the insurance is bought (Fla. Stat. § 627.404). The same statute bars the business from retaliating against a key person who refuses to consent. Ask for the signed consent form and keep it in the file.

Review these roles when circumstances change. A move abroad, a change in ownership or a new beneficiary can each shift who holds rights under the contract. Check the policy after any of these events.

What Happens When the Insured Dies

The claim usually starts when the owner or beneficiary notifies the insurer and sends written proof of death. The insurer then reviews the policy, including whether it was in force, its exclusions and its claim terms. Florida requires a lump-sum death payment to include interest from the date the insurer receives written due proof of death (Fla. Stat. § 627.4615). That interest rate must be equal to or greater than the Moody’s Corporate Bond Yield Average-Monthly Average Corporate as of the day the claim was received. If the method of calculating such index is substantially changed from the method of calculation in use on January 1, 1993, the rate must not be less than 8 percent.

Timing rules matter too. Florida requires life policies to become incontestable after they have been in force during the insured’s lifetime for 2 years from issue, except for nonpayment of premiums and, at the option of the insurer, as to provisions relative to benefits in event of disability and as to provisions which grant additional insurance specifically against death by accident or accidental means (Fla. Stat. § 627.455). Even after that period, an insurer can still rely on provisions that exclude or restrict coverage (Fla. Stat. § 627.463). That is why the exclusions section of the policy deserves a close read.

The insurer, not our firm, decides claim payments under the policy.

Policy Terms to Check When the Insured Lives Abroad

Start with the policy form. Look for residence, travel and territorial wording. Check the exclusions and any deadline for filing a claim notice.

Next, ask the insurer in writing how it handles a death outside the United States. Ask which documents it needs. Foreign death certificates, translations and authentication can affect how long the paperwork takes. Getting those answers before a claim is far easier than sorting them out during one.

When you discuss a specific policy, name the insurer and the policy form number from the policy’s first page. Insurance is offered through Nischay Rawal, a licensed insurance agent, separately from the firm’s accounting practice.

Have questions about what happened?

Ask our team directly. That makes premium status central. Florida requires every insurance contract to give a grace period of not less than 30 days to pay a premium after the first (Fla. Stat. § 627.453). The policy stays in force during that period.

The grace period has limits. The insurer may charge interest on the late premium, at no more than 8 percent per year. If a claim occurs during the grace period before the overdue premium is paid, or the deferred premiums of the current policy year are paid, the overdue premium (or those premiums) with interest not exceeding 8 percent per year may be deducted in the settlement. That deduction reduces what the settlement pays.

When a key person relocates, billing addresses and bank accounts often change. Confirm both with the insurer. A missed notice is easy to overlook from abroad. Review the policy early, not after a claim.

Tax and Reporting Questions Tied to the Policy

Premium deductibility depends on who the beneficiary is. Federal law says no deduction is allowed for premiums on a life insurance policy if the taxpayer is directly or indirectly a beneficiary under it (26 U.S.C. § 264).

Death proceeds are generally excluded from gross income, subject to listed exceptions (26 U.S.C. § 101). Under Internal Revenue Code section 6039I, an applicable policyholder that owns one or more employer-owned life insurance contracts issued after that section was enacted must file a return for each year the contracts are owned. The return shows the number of employees, the number of those employees insured, the total insurance in force, the name, address, and taxpayer identification number of the policyholder and the type of business it is engaged in, and whether the policyholder has a valid consent for each insured employee (or, if not all consents are obtained, the number of insured employees for whom consent was not obtained). Keep estate inclusion separate. Proceeds receivable by the executor are included in the gross estate (26 U.S.C. § 2042). That matters when a policy pays the estate instead of the business.

Our CPA view can show how premiums and any proceeds fit the business’s tax picture. It cannot promise a particular tax result, because the policy’s structure and the business’s own facts drive the answer.

If the Key Person Plans to Move Abroad

A move abroad can change ownership, premium and claim questions. Think carefully before you replace or give up an existing policy. Florida requires an agent who recommends surrendering an annuity or life insurance policy with cash value, without recommending that the proceeds fund or purchase another annuity or life insurance policy, to provide written information before the surrender. That information includes the estimated surrender charge, possible tax consequences and any forfeited death benefit (Fla. Stat. § 627.4553). Ask for a written comparison before any replacement.

Bring these questions to a coverage review before any change. Who owns the policy, and who is the beneficiary? Is the policy in force, and when is the next premium due? Does the consent form still stand? What does the policy say about residence? What will the insurer need if a claim is made?

Want to know where you stand?

Tell us about your situation and our team will walk you through the options available to you.

Request a coverage review

Request a coverage review

Talk Through Your Situation With Our Team

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does key person insurance pay if the insured dies abroad?

It depends on the policy’s terms, whether it was in force at death, and the claim documents the insurer requires.

Under Fla.
