A life insurance beneficiary can generally live outside the United States. Where the beneficiary lives affects how the payout is delivered, documented and reported. It does not decide whether the policy can name them.

A beneficiary is the person or entity the policy owner names to receive the death benefit, but for a policy on another person’s life, the benefits must be payable to the insured or the insured’s personal representatives, or to someone with an insurable interest in the insured when the contract is made. The insured is the person whose life is covered. The policy owner holds the policy and makes the choices about it. These can be one person or three different people.

Families in Miami and across Florida may have relatives abroad who depend on them. Indian-American households often name a parent, sibling or spouse in India. This page explains what changes when the beneficiary lives overseas. It covers term life insurance, whole life insurance, estate planning life insurance and NRI life insurance questions.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

How Does an Insurer Pay a Beneficiary Who Lives Abroad?

The beneficiary files a claim with the insurer, and the insurer sets the paperwork and payment steps. The process usually follows a clear order.

First, the beneficiary sends a claim. Insurers usually ask for a certified death certificate and their own claim forms.

Second, the insurer checks identity and address. A beneficiary overseas may be asked for a passport or other proof of identity. Ask for the insurer’s list in writing before a claim is needed.

Third, the insurer chooses how to pay. Common options include a check, a wire or a bank transfer. Ask how the insurer pays in another currency and which exchange rate it uses.

Fourth, interest may apply. Florida law says a lump-sum payment must include interest from the date the insurer gets written due proof of death, as Fla. Stat. § 627.4615 describes. The rate must equal or exceed the Moody’s Corporate Bond Yield Average.

Sanctions rules are a separate check.

Missing documents can slow a claim. Gather the paperwork before it is needed.

Does Insurable Interest Depend on Where the Beneficiary Lives?

No. Insurable interest depends on the relationship between the policy owner and the insured when the policy is issued. It does not depend on the beneficiary’s mailing address.

Fla. Stat. § 627.404 says any individual of legal capacity may buy insurance on his or her own life for the benefit of any person. A person may not buy insurance on another person’s life unless the benefit goes to that insured, the insured’s personal representative, or someone with an insurable interest when the contract is made. That interest does not need to last after coverage starts.

Spouse, parent, child and business ties are common examples. The insurer and state law set the detailed rules. A business may also hold an insurable interest in a key employee or key person. The statute requires that person’s written consent before the insurance is bought.

The policy owner’s own tie to the insured matters most. Naming a relative abroad does not change that test.

Are Life Insurance Death Benefits Taxable to a Beneficiary Abroad?

Generally, the death benefit itself is not counted as the beneficiary’s income under the US rule. 26 U.S.C. § 101 says gross income generally does not include amounts received under a life insurance contract when paid by reason of the insured’s death, except as otherwise provided in paragraphs (2) and (3), subsection (d), subsection (f), and subsection (j).

Interest is treated differently. The IRS guidance on life insurance proceeds explains how a death benefit and any interest are treated. Ask the insurer how interest will be reported if a payout is delayed.

The beneficiary’s country of residence may have its own rules on inheritances or insurance proceeds. Those rules vary by country. Families should plan for them before a claim is filed.

Our CPA team can help the policy owner and family plan cash flow and reporting questions before a claim. This planning sits alongside the insurance decision.

Have questions about what happened?

Ask our team directly. The transfer must match one of the listed situations in sections 2036 to 2042. 26 U.S.C. § 2042 includes life insurance proceeds in the gross estate to the extent receivable by the executor as insurance, and, for other beneficiaries, to the extent receivable by them when the decedent possessed at death any incidents of ownership exercisable alone or with another person; a reversionary interest counts only if its value exceeded 5 percent of the value of the policy immediately before the decedent’s death.

If the payout goes to the insured’s estate, it becomes part of that estate and follows probate law.

Some families use an irrevocable life insurance trust to own the policy. A trust is a separate question from who receives the payout. Both should be reviewed together with the family’s other advisors.

For a non-citizen spouse, the gift rules work differently. The IRS notice addresses the gift-tax treatment of gifts to a spouse who is not a citizen of the United States.

What Changes for NRI Policy Owners on the Application?

The application asks about residency, citizenship and address. Those answers shape which products and carriers are available.

Florida law requires an insurance agent to be currently licensed and appointed. Fla. Stat. § 626.112 says no one may act as, advertise or hold out as an insurance agent without that licensing. Fla. Stat. § 626.112 reads: “(1)(a) No person may be, act as, or advertise or hold himself or herself out to be an insurance agent, insurance adjuster, or customer representative unless he or she is currently licensed by the department and appointed by an appropriate appointing entity or person.” Ask which products are available where you live before you apply.

A policy owner living abroad may face different application and payment rules than one living in the US. Ask the insurer for those requirements in writing.

Insurance is offered by Nischay Rawal, a licensed insurance agent, separately from the accounting practice of NR CPAs & Business Advisors. Any specific policy we discuss is named with its insurer.

Practical Steps Before Naming a Beneficiary Abroad

Confirm the beneficiary’s full legal name, contact details and identity documents before you sign. A name that doesn’t match a passport can slow a claim.

Keep beneficiary designations current. Review them after a marriage, divorce, birth or move. Keep copies of key documents where your family can find them.

Ask the insurer for its overseas claim and payment requirements in writing. Review the policy at regular intervals so the details still match your family’s situation.

A coverage review is our first meeting with you. We look at your situation, the beneficiary’s location, tax questions and family goals.

If a certified public accountant or firm engaged in the practice of public accounting accepts a commission for the sale of a product or service to a client, it must disclose that fact to the client in writing under board rules Fla.
