It can. The insurer sets the premium, and the policy form states whether and how it changes as the insured gets older.

This page explains which policy terms control a renewal premium, what to check in your documents, and how a higher premium fits into a business budget. It is written for Florida business owners, partners and finance leads who are named on a key person policy, including Indian-American and NRI owners.

NR CPAs & Business Advisors is a Miami CPA firm. We look at key person coverage with a CPA’s view of tax and cash flow, because the premium is a cost the business has to plan for.

How Key Person Insurance Premiums Are Set

The insurer sets the premium. The policy form and the insurer’s rate schedule set the rules. A key person policy is a life insurance contract that a business typically buys on the life of an owner, partner or key employee.

Three terms come up again and again. The premium is the amount paid to keep the policy in force. A renewal is the point where a term policy continues past its set period. An age-based change is a premium that moves when the insured reaches a certain age or renewal year.

These inputs live in your documents, not in a general article. A general guide can explain the pattern. It cannot give your figure, because that figure depends on the insured’s age, health and the insurer’s schedule. Ask the question with the actual contract in hand.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Do Insurance Premiums Increase With Age?

Some policies do, and some do not. A policy may state a premium that changes with the insured’s age. Or it may state a level premium for a set period. The policy form says which one applies.

Do not rely on a summary of how premiums usually work. Open the policy and look for the age-based change language. Check whether the premium steps are written into the contract as a schedule, and note the year each step starts.

Look at timing as well. A level premium can hold steady for a set period and then reset. If nobody marks that date, the first higher bill can catch the business off guard.

Age can also matter in a different way. If the insured’s age was recorded wrong, Florida law changes the benefit. Fla. Stat. § 627.456 says the benefit becomes what the premium would have bought at the correct age, using the insurer’s rate at the date of issue. That rule corrects the contract. It does not fix a premium the business failed to plan for.

Renewable Term Key Person Policies and Renewal Premiums

A renewable term policy can continue after its first term ends. The renewal premium follows the policy’s terms, not a general rule.

Term coverage lasts for a set number of years. The Alabama Department of Insurance policy types guide explains that term policies may offer renewal or conversion. That is a general overview, so your own policy wording still controls.

Read three parts separately. First is the level-premium period, when the rate stays the same. Second is the renewal right, which says whether the coverage can continue. Third is the renewal premium basis, which says how the new premium is figured.

Where the policy shows age bands or renewal years, that schedule controls the step-up. The schedule should appear in the policy documents you received at issue. Find it before the renewal date, not after the notice arrives.

Keep the two periods apart in your mind. The level-premium period and the renewal period sit in the same contract, but they can carry different premium terms.

Whole Life Key Person Premiums and Cancellability

A whole life key person premium is usually stated in the policy form. The cancellation and surrender terms decide what happens if the business stops paying.

Whole life insurance covers the insured for life and includes a cash-value feature. FINRA term and permanent insurance explains that term coverage has a limited period, while whole or permanent coverage lasts for the insured’s lifetime.

Read guaranteed values and non-guaranteed values as two different things. Dividends, where the policy pays them, are not guaranteed. So a projection that includes them is not a promise of any particular result.

Cancellation is its own question. Check the policy’s terms for the owner’s right to cancel. Then check what a surrender or lapse does to the cash value. FINRA guidance on exchanging life insurance points to surrender charges and cash value as items to weigh.

Florida’s policy loan rules also matter for whole life. Fla. Stat. § 627.458 states that its policy loan section does not apply to term policies or to term insurance benefits provided by riders.

Have questions about what happened?

Ask our team directly. The business should map it into the budget before the renewal date arrives.

Put each premium year on the budget calendar as an operating line. Compare it with the business’s other expenses and with its plan for covering the loss of a key person. The Insurance Information Institute key employee coverage page explains that this coverage compensates a business for financial losses caused by a key employee’s death or disability.

Document ownership in writing. Record who owns the policy, who pays the premium and who is the beneficiary. Keep those names consistent across the policy, the company records and the tax file, so the premium change is recorded correctly.

Consent matters too. Fla. Stat. § 627.404 allows a business to insure a key employee only if written consent is obtained before the insurance is bought. The business may not retaliate against someone who refuses.

If the policy is employer-owned, federal reporting can apply. 26 U.S.C. § 6039I requires an applicable policyholder that owns one or more employer-owned life insurance contracts issued after the date of enactment of this section to file a return each year. That return covers the number of insured employees and whether valid consent exists for each one.

Questions to Answer Before Any Renewal Premium Changes

The exact monthly cost cannot come from a general article. Pull the figure from the policy documents before each renewal.

Find these five items in the policy: the renewal terms, the age-based change language, the premium schedule, the cancellation terms, and the insurer’s name with the policy form number.

Florida law sets some baseline rules for life policies.

Incontestability is another baseline. Every life contract must become incontestable after 2 years from its date of issue, except for nonpayment of premiums. Fla. Stat. § 627.455 sets that rule, with some insurer options for disability and accidental death provisions. Fla. Stat. § 627.455 reads: “Every insurance contract shall provide that the policy shall be incontestable after it has been in force during the lifetime of the insured for a period of 2 years from its date of issue except for nonpayment of premiums and except, at the option of the insurer, as to provisions relative to benefits in event of disability and as to provisions which grant additional insurance specifically against death by accident or accidental means.”

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does key person insurance renewal premium increase with age?

It can. The owner also needs to know what the cancellation terms say and how the new cost fits the year’s budget.

A coverage review looks at the policy form and the insurer’s schedule together.
