The issued policy controls what is excluded, so the wording in your own contract matters most. Common exclusions include suicide early in a policy, material misstatements on the application, certain war and aviation deaths, and deaths outside an accidental death rider’s terms.

Exclusions also differ between term and whole life policies, and between personal and business-owned policies. Florida law adds an important rule. An incontestability clause stops an insurer from contesting a policy’s validity, but it doesn’t stop the insurer from relying on exclusions later, as Fla. The policy sets that length, so look for the exact number of months or years in your contract. After that period, many policies pay the death benefit for suicide under their terms.

A death by suicide is a painful subject, especially for a family reading after a loss. Take your time with the policy language. Read the suicide provision, the period it covers, and the wording on how the insurer applies it. Write down any sentence you don’t understand so you can ask about it later.

Misstatements or omissions on the application

A material misstatement is a wrong or missing answer that would have changed whether, or on what terms, the insurer issued the policy. The insurer reviews the application, including any health questions. Issue may depend on insurability.

Florida law generally makes a life policy incontestable once it has been in force during the insured’s lifetime for two years from its date of issue, with exceptions such as nonpayment of premiums, as Fla. Stat. § 627.455 provides. If age or sex was misstated, the benefit is what the premium would have bought at the correct age or sex, under Fla. Stat. § 627.456. Keep the original application and any amendments. They’re the first documents anyone reviews when a claim question comes up.

War, military, and aviation exclusions

Some policies exclude deaths caused by war, acts of war, or certain military service. Others exclude deaths from specified flying, such as piloting certain aircraft. The wording and any time limits vary by policy and by insurer.

Read each definition word by word instead of relying on a general summary. Compare the definitions to the facts that actually happened, such as the aircraft involved, the person’s role, and the dates. The contract’s definitions control, so a short summary can miss a key term.

Have questions about what happened?

Ask our team directly. The base policy may still pay its death benefit in other cases. Florida law lets an insurer choose whether accidental death provisions fall outside the general incontestability rule, as Fla. Stat. § 627.455 states.

So is dying during surgery accidental? It isn’t automatic. The cause of death and the rider’s definition both decide that question. Some riders also exclude deaths tied to illness, certain medical treatment, or intoxication. Ask for the rider’s full definitions and exclusions in writing, and read them next to the surgery records.

Who pays funeral costs when a death is excluded

When no death benefit is payable, the funeral bill still has to be paid. It usually falls to the estate, to other accounts, or to the person who signs the funeral home contract. That signer is often a family member, so check the contract before anything is signed.

For a decedent who was a U.S. citizen or resident at death, federal tax rules allow certain funeral expenses to be deducted from the gross estate when they are actually expended, would be properly allowable out of property subject to claims under the laws of the local jurisdiction, and satisfy the requirements of paragraph (c) of § 20.2053-1, as 26 C.F.R. § 20.2053-2 provides. That deduction lowers the taxable estate. It doesn’t pay the funeral bill itself. Planning for funeral costs is a separate decision from the death benefit, and some families review coverage in advance for that reason.

How these exclusions apply to key person and buy-sell policies

A key person policy pays the business, as owner and beneficiary, when a key employee or owner dies. The same types of exclusions can appear in that contract. Florida law lets a business hold an insurable interest in an owner, officer, manager, or key employee when that person gives written consent before the policy is bought, under Fla. Stat. § 627.404.

Buy-sell agreement insurance is tied to the agreement’s terms. Read the policy’s exclusions and the agreement’s triggers together. Under the same statute, each individual party to a contract for the purchase or sale of an interest in a business entity has an insurable interest in the life of each other party to that contract, for that contract only. The owner, insured, and beneficiary roles on a business policy also change how the application and any claim are reviewed. Keep the signed consents and the buy-sell agreement with the policy file.

Talk with the responsible agent about your policy

If you’re reading this after a death in your family, or while a business partner’s loss is still unfolding, these questions can feel urgent and personal.
