In most individual policies, it runs two years from the issue date. When a company owns a policy on an essential employee, that window matters to the business as well as the employee.

What the Key Person Insurance Contestability Period Means

The contestability period is the first stretch of a life insurance policy, when the insurer may look back at the application and challenge a claim. Key person insurance is life insurance a business buys on an owner or essential employee. The Insurance Information Institute describes it as a way to compensate a business for financial losses caused by a key person’s death or disability.

Usually, the business owns the policy, pays the premiums and is named as beneficiary. Many owners assume the window only affects the insured person. For a company policy, the business is the party that collects the benefit and carries the risk of a dispute.

The period is not a waiting period before coverage starts. It also does not set the death benefit amount. It limits how long the insurer can contest the policy’s validity. Florida law sets the basic rule, explained below.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

How Long the Usual Two-Year Period Lasts

Most individual life insurance policies use a two-year period that starts on the policy’s date of issue. Florida law requires life insurance contracts to become incontestable once they have been in force during the insured’s lifetime for two years from the date of issue. The law makes exceptions, and unpaid premiums is one of them (Fla. Stat. § 627.455).

The clock starts at issue, not when you applied or first paid. Look at the issue date on the contract, because that date controls the count.

Your policy contract is the document that spells out its specific terms, so review it carefully. Confirm the period in the issued contract rather than relying on what most policies generally say. Keep a full copy of that contract in your company’s records.

What an Insurer Can Review During the Period

An insurer can review application answers, including health history, occupation and other facts about the person insured. Errors in those answers can lead to questions. Florida law adjusts a death benefit when the insured’s age or sex was misstated. The benefit becomes what the premium would have bought at the correct age or sex (Fla. Stat. § 627.456).

Picture a company that applies for a policy on its top sales leader and leaves out a recent heart condition. If a claim comes in during the window, the insurer may review that answer closely.

Florida law also lets an insurer rely, in good faith, on the applicant’s statements about insurable interest (Fla. Stat. § 627.404). For a key person policy, a business entity has an insurable interest in the life, body, and health of its owners, directors, officers, partners, and managers, or those of any affiliate or subsidiary, or of its key employees or key persons, if consent is obtained in writing from the key employees or persons before the insurance is purchased.

Consent is part of the file too. Before the business buys the policy, it needs the key employee’s written consent. It may not retaliate against a key employee who refuses. Keep signed consent forms, application copies, medical records requests and underwriting letters in one place. A complete file makes questions easier to answer.

What the Policy and Florida Law Control

The issued policy and Florida law decide how the period and any exclusions apply to your company’s policy. Florida’s incontestability rule limits a challenge to the policy’s validity. It does not stop an insurer from raising defenses based on provisions that exclude or restrict coverage, at any time (Fla. Stat. § 627.463).

That is why the exclusions section matters as much as the two-year clock. Read it closely, along with any age-based terms.

Florida also requires a grace period of at least 30 days for each premium after the first. The policy stays in force during that period (Fla. Stat. § 627.453).

Write down the policy form number and page references. That makes it easier to check terms later.

Have questions about what happened?

Ask our team directly. Premium and exclusion terms still apply.

A claim filed inside the window may take longer, because the insurer may review the application and records first. When a lump-sum death claim is paid, Florida law requires interest from the date the insurer gets written proof of death. The annual interest rate must be equal to or greater than the Moody’s Corporate Bond Yield Average-Monthly Average Corporate as of the day the claim was received (Fla. Stat. § 627.4615).

The business file usually includes proof of death, policy ownership records, the signed consent and records showing the company’s interest in the key person. Each file should be easy to read later, by you, your CPA and your insurer.

Tax treatment belongs in that file too. Premiums are generally not deductible when the taxpayer is a beneficiary under the policy (26 U.S.C. § 264).

Preparing Your Application and Next Steps

Accurate, complete application answers are the most direct way a business can cut down questions during the contestability period. Think about the documents before a claim is made, not after.

Before the application is filed, gather the key employee’s health and occupation facts, the company’s ownership records and the signed written consent. Answer every question, and ask about anything unclear.

A coverage review helps a business check policy terms, the key employee’s role and the company’s need for coverage. Florida businesses, including those in Miami, and NRI and Indian-American owners face the same two-year clock.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long is the key person insurance contestability period?

In most individual policies, it is two years from the issue date.
