Three things decide it: the policy wording, the date of death, and whether premiums were kept current. Living or traveling in India does not replace those contract terms.

This page answers three questions. Who gets paid? Which documents does the company need? Which exclusions could apply? The policy itself controls each answer, so read your own contract rather than a summary. Nischay Rawal, a licensed insurance agent, reviews these terms for business owners and families at NR CPAs & Business Advisors, a Miami CPA firm.

This matters most when a key employee moves or travels abroad while the company keeps the policy in its own name. Sorting out ownership and premium status before a trip is easier than sorting them out after a death.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Who owns, insures and is paid under a key person policy

Every key person policy has three roles. The owner holds the policy and pays the premiums. The insured is the key person whose life is covered. The beneficiary receives the death benefit. Match your policy’s own labels to these roles.

In most business cases, the company is the owner and beneficiary. The insured is an owner, officer or key employee. That setup means the death benefit goes to the business, not to the family. The company then decides how to use the money, such as covering lost sales or paying a loan.

Florida law lets a business insure a key person when written consent is obtained before the policy is bought. The law also bars the business from punishing a key person who refuses consent. Keep a signed consent form in the company file. Check that the owner and beneficiary on the application match the company’s records. A mismatch can slow the claim.

What happens to the policy when the insured dies

The policy stays in force on the date of death when premiums were paid as the contract requires. Florida law requires a grace period of not less than 30 days for each premium after the first. Fla. Stat. § 627.453 During that grace period, the policy continues in force. The insurer may charge interest on the late days, at no more than 8 percent per year.

If a claim comes in during the grace period before the overdue premium is paid, or before any deferred premiums for the current policy year are paid, those premiums, with interest not in excess of 8 percent per year, may be deducted from the settlement under the policy. So a late premium can reduce what the company receives.

Separate the insured’s death from the owner’s death. If the insured dies, the death benefit goes to the beneficiary under the policy’s terms. If the owner dies, the policy’s ownership rules decide who controls it. Look for a successor owner clause and any change-of-owner provision. Don’t assume the company’s operating agreement controls the policy. The policy’s own forms do.

Exclusions to check: suicide, early-policy-year limits and contestability

Some life policies exclude death by suicide for a set period after the policy is issued. The length and wording appear in your policy. Check the exclusion section and compare it with the date of death.

Contestability works differently. Florida law makes every life policy incontestable after it has been in force for two years from its date of issue, except for nonpayment of premiums. During those first two years, the insurer may contest the policy’s validity. The window runs from the issue date, not from the date of any trip or move.

After that window, the clause does not stop defenses based on exclusions and restrictions. An exclusion can still matter after year two. Also, if the insured’s age was misstated, the benefit changes to what the premium would have bought at the correct age. If the age or sex of the insured has been misstated, the amount payable is what the premium would have purchased at the correct age or sex.

Travel and residence in India: provisions to read in the policy

Some policies contain travel, residence or territorial terms. These terms can change how a policy reads for an insured who lives or works abroad. Look for them in the base policy and in every rider attached to it.

Check the application too. If it asked where the insured lives or travels, and that answer changes, tell your agent. Florida law lets an insurer rely on an applicant’s statements about insurable interest, so accurate statements matter. Under Florida law, a person may buy life insurance on another individual only if the benefits are payable to the insured or his or her personal representatives, or to someone who has an insurable interest in the insured when the contract is made.

The practical step is simple. Keep a dated file with the policy, the consent form, the travel dates and each change notice. A dated file lets the company show what it knew and when. A move can raise questions that only the policy wording answers.

Have questions about what happened?

Ask our team directly. Most company claims include the insurer’s claim form, the policy and any riders, a death certificate, and proof of the company’s ownership and insurable interest.

A death certificate issued in India may need a certified copy. If it is not in English, the insurer may ask for a certified translation. Confirm which copies and translations the insurer accepts before you send them.

Florida law adds a timing rule. When a policy pays a lump sum at death, the payment must include interest from the date the insurer receives written due proof of death. Interest on a lump-sum death benefit runs from the date the insurer receives written due proof of death, so sending complete proof promptly keeps that timeline clear.

Company records matter as well. Keep the premium payment history, the policy schedule, the signed consent and a note of the insured’s role in the business. These records support the claim and the company’s bookkeeping.

Tax and cash-flow questions a CPA view adds

Federal law generally excludes life insurance death benefits from gross income, subject to listed exceptions. Employer-owned policies are subject to special federal tax rules. For an employer-owned life insurance contract, federal tax law can cap the portion of the death benefit the policyholder receives that is excluded from income tax at the total of the premiums and other amounts the policyholder paid for the contract. The exceptions to that cap apply only where the written notice and consent requirements of IRC § 101(j)(4) are met before the policy is issued.

An applicable policyholder (as defined in section 101(j)) that owns one or more employer-owned life insurance contracts issued after August 17, 2006 must file a return under 26 U.S.C. § 6039I.

Whether proceeds are taxable depends on the facts. The IRS explains how to tell when proceeds are taxable. Estate questions can also arise. Proceeds on a decedent’s own life can be part of the gross estate when he held incidents of ownership. Under federal estate tax rules, life insurance proceeds are included in the value of the gross estate when they are receivable by the executor, or by other beneficiaries if the decedent held any incidents of ownership in the policy at death.

26 C.F.R. § 20.2042-1

On cash flow, the Insurance Information Institute explains that key person insurance compensates a business for financial losses from the death or disability of a key employee. The firm’s CPAs can address tax and cash-flow questions alongside the coverage review.

Planning before a key person travels or moves to India

Start with the file. Confirm the owner and beneficiary match company records. Confirm premiums are current and note the due dates. Store the policy, the consent form and the contact details where the company can reach them. Write down the insured’s travel and move dates.

Next, check the policy’s exclusion and travel terms against those dates. A death during a planned trip or long stay raises the same core questions as any death: the policy wording, the issue date and the premium status.

A coverage review of your policy with Nischay Rawal can show how these terms apply to your facts.
