Yes. Where a beneficiary lives can raise practical questions, and these are worth raising in a coverage review with our team. The harder questions are how the claim gets paid and who owns the policy.

People ask this for different reasons. A parent may live in India. A spouse or child may have moved overseas. A business partner may live abroad and own part of a company. Each case raises its own questions.

The short answer: yes, a beneficiary can live outside the US

The main legal test is insurable interest, which means a real family or financial stake in the insured’s life. Under Fla. Stat. § 627.404, a person may buy coverage on his or her own life for the benefit of any person. Benefits must generally go to the insured, the insured’s personal representatives, or someone with an insurable interest when the contract was made.

The insurable interest does not have to last after coverage starts. The statute’s test looks at the stake when the contract is made. Your policy’s wording and the insurer’s written claim instructions still decide how a payout works. Check those details for your own policy before you rely on them.

If you are naming a parent, spouse, child or partner who lives abroad, request a coverage review with our team. Give the person’s full legal name, relationship and contact details. Ask the insurer what it needs for a foreign address and phone number, so the form is complete from the start.

Naming a beneficiary is not the same as owning the policy. The owner controls the policy, including any changes to it. The beneficiary receives the death benefit. For more on that split, read our third-party owner guide.

Ownership also matters for estate tax. Under 26 U.S.C. § 2042, life insurance proceeds receivable by the executor are included in the gross estate. Proceeds receivable by other beneficiaries can be included too, if the decedent held incidents of ownership at death. IRC § 2042 reads: “For purposes of the preceding sentence, the term “incident of ownership” includes a reversionary interest (whether arising by the express terms of the policy or other instrument or by operation of law) only if the value of such reversionary interest exceeded 5 percent of the value of the policy immediately before the death of the decedent.”

Name a contingent beneficiary as well. This person receives the benefit if the primary beneficiary cannot. Review the form after a move, marriage, divorce or death in the family. A form signed years ago may no longer match your plans.

For a Florida resident, Fla. Stat. § 222.13 says proceeds go to the person designated. They are exempt from the insured’s creditors unless the policy or a valid assignment provides otherwise, but if the insurance is payable to the insured, the insured’s estate, or the executors, administrators, or assigns, the proceeds become part of the insured’s estate for all purposes.

What an insurer typically needs to pay a claim to someone abroad

A claim usually starts with a claim form, a death certificate and proof of who the beneficiary is. The exact list comes from the insurer’s written instructions, and those instructions govern the process. Ask for them early, while the policy is in force.

Documents for a beneficiary overseas can take more work to gather. Identity papers, certified copies and translations may be needed, depending on what the insurer asks for. Starting the list early keeps the claim moving.

Lump-sum payments carry interest. Under Fla. Stat. § 627.4615, a lump-sum death payment must include interest. The interest runs from the date the insurer receives written due proof of death, at an annual rate equal to or greater than Moody’s Corporate Bond Yield Average (monthly average corporate) as of the day the claim was received; if the method of calculating that index has substantially changed from the method in use on January 1, 1993, the rate must not be less than 8 percent.

Tax treatment also matters. Under 26 U.S.C. § 101(a), death benefits are generally not gross income to the beneficiary.

Payment questions to settle before a claim

Settle payment questions early, because the insurer’s process decides how funds reach a bank overseas. Ask which currency it pays in, how it sends funds, and what bank details it needs. Write those answers down with your policy papers.

Once an insurer pays as the policy directs, it is generally released from further liability. Florida law says the insurer is not responsible for how the money is later applied. That is why the account details must be right from the start.

Raise any country-specific concern with the insurer before naming a beneficiary, not after a death. Early questions give your family clearer answers when they need them most.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Key person and buy-sell policies when an owner or partner lives overseas

In key person coverage, the business is often the policy owner and beneficiary. The coverage pays the business when a key person dies, so a partner’s address matters less than it does in a personal policy. According to the Insurance Information Institute, key person life insurance compensates a business for financial losses caused by the death or disability of a key employee.

Florida law ties a business’s insurable interest in owners and key persons to written consent. Under Fla. Stat. § 627.404, that consent must be obtained before the insurance is bought. The business may not retaliate against a key person who refuses.

Buy-sell agreement insurance depends on the written agreement between owners. If one co-owner lives overseas, address that in the agreement and with the insurer before a death. Our key person insurance guide and buy-sell agreement insurance page explain each structure.

Planning for a family split across borders

NRI life insurance is coverage for people who live outside the US or have family abroad.
