Yes, the owner usually can. The policy’s terms and the owner’s choice decide what happens next. The main routes are surrender for cash value, stopping premiums, reduced paid-up coverage, extended term coverage, and borrowing against the policy. Each one changes the death benefit, the money you may receive, and possibly your taxes.

The owner makes this choice, and the owner may not be the person insured. An adult child, a spouse, or a business can own a policy on someone else’s life. Check who the owner is before anyone takes action.

The right route depends on the facts: the policy’s values, any loan balance, and your cash flow. The Florida Department of Financial Services life insurance guide explains cash value, policy loans, and beneficiaries in plain terms. That window is tied to delivery, so the delivery date on your paperwork matters. If you’re still inside it, decide early, because the window will close.

Once that window passes, surrender is a different decision. Surrender pays the policy’s cash value, which can be less than the premiums you paid, especially in the early years. Treat the return window and a later surrender as separate decisions with separate results.

Many people find an old policy while sorting a parent’s papers. If that’s you, start by finding the delivery date and the owner’s name.

What Does Surrender Pay? Cash Surrender Value Explained

Surrender pays the cash surrender value, the amount the insurer pays when the owner ends the policy before its maturity date. A surrender is the owner’s voluntary request to end a life insurance policy before its maturity date in exchange for the policy’s current cash surrender value.

Some values are guaranteed and others are not. Dividends, where a policy pays them, are not guaranteed. Read the guaranteed and non-guaranteed figures separately, never as one number.

Surrender charges can lower what you receive, especially in the early policy years. Any policy loan and unpaid loan interest come out of the amount too. An illustration or annual statement shows these figures, but it is an estimate, not a promise. Cash value is not a savings account balance, and surrender ends the death benefit.

Taxes When You Surrender or Withdraw Cash Value

Surrender can have tax consequences, and the result depends on the policy’s history. Florida law requires written information first in one common case. If an agent recommends surrendering a policy with cash value, and does not recommend using the money for another life or annuity policy, the agent must give that information before the surrender. It includes possible tax consequences and any forfeited death benefit. Fla. Stat. § 627.4553

Death benefits are treated differently. Under federal law, amounts paid because of death are generally excluded from gross income, with listed exceptions. Interest paid on proceeds the insurer holds is taxable.

A policy loan or partial withdrawal can be treated differently from a full surrender. Compare each route before you choose. Before any surrender request goes to the insurer, a CPA on our team can review the tax picture with you.

Have questions about what happened?

Ask our team directly. Florida law treats reduced paid-up and extended term options as separate from surrender. Each route has its own terms.

Policy loan. Borrowing against cash value keeps the policy in force while the loan is outstanding. Florida law says the loan value is at least the cash surrender value at the end of the current policy year. Fla. Stat. § 627.458 allows a policy to provide that unpaid interest is added to the debt when it is not paid when due. If the debt equals or exceeds the loan value, the policy can terminate, but only after at least 30 days’ notice is mailed.

Reduced paid-up coverage. Premiums stop, and coverage stays in force for life at a smaller death benefit. The new amount depends on the policy’s values.

Extended term coverage. The original face amount can continue for a set period. The length depends on the policy’s values and contract terms.

Missed premiums. Fla. Stat. § 627.458 reads: “The loan value of the policy shall be at least equal to the cash surrender value at the end of the then-current policy year, except that the insurer may deduct, either from such loan value or from the proceeds of the loan, any existing indebtedness not already deducted in determining such cash surrender value, including any interest then accrued but not due, any unpaid balance of the premium for the current policy year, and interest on the loan to the end of the current policy year.” Fla. Stat. § 627.4555 provides that a life insurance contract covering a natural person 64 years of age or older, issued on or after October 1, 1997 and in force for at least 1 year, may not be lapsed for nonpayment of premium unless, after the grace period and at least 21 days before the effective date of any such lapse, the insurer has mailed a notification of the impending lapse in coverage to the policyowner and to any secondary addressee designated in writing; this does not apply to contracts with premiums payable monthly or more frequently that are regularly collected by a licensed agent or paid by credit card or preauthorized check or automatic debit.

Replacement and business policies. Federal law can allow a tax-free exchange of one life policy for another in some cases. 26 U.S.C. § 1035 provides that no gain or loss is recognized on certain exchanges of one life insurance contract for another life insurance contract, among other exchanges.
