In most policies, the insurer agrees to pay the death benefit to the named beneficiary once it receives proof of the insured’s death, as long as the policy’s terms are met. Some people call it the insuring clause.

The exact wording depends on the insurer and the policy form. Read your own document rather than relying on a summary. A simple version might read: “We will pay the death benefit to the beneficiary when we receive proof of the insured’s death, subject to the terms of this policy.”

The Florida life insurance guide from the Florida Department of Financial Services covers the main types of life insurance, cash value, policy loans and beneficiaries. Definitions, exclusions, riders and premium terms all affect what the promise means in practice.

Florida law shapes what a life policy must contain. Fla. Stat. § 627.452 says a life policy must include the standard provisions the statutes require, or provisions more favorable to the policyholder. Those standard provisions are not all applied to single-premium or term policies.

To find the clause, look for the section that says what the insurer will pay and to whom. Then read the defined terms it uses, such as “death benefit” or “proof of death.” Those words control the promise.

Premium terms matter too. Fla. Stat. § 627.453 requires a grace period of not less than 30 days for any premium after the first. The policy stays in force during that grace period.

What the Clause Promises and What It Does Not Cover

The insuring agreement promises the death benefit. It does not describe cash value, policy loans or dividends. Those appear in other sections of the policy.

Dividends, where a policy pays them, are not guaranteed. Ask the insurer to show guaranteed and non-guaranteed values separately so you know which figures are which.

Exclusions can limit what is payable. Time limits also matter. Fla. Stat. § 627.455 says a policy must be incontestable after it has been in force during the insured’s lifetime for 2 years from its date of issue, except for nonpayment of premiums and, at the insurer’s option, as to disability benefits and additional accidental death insurance. But Fla. Stat. § 627.463 says that rule only precludes a contest of the policy’s validity. The insurer can still assert defenses based on provisions that exclude or restrict coverage.

When a lump-sum death benefit is paid, interest must be included, as required by Fla. Stat. § 627.4615. Fla. Stat. § 627.4615 says that payment must include interest from the date the insurer receives written due proof of death.

How the Insuring Agreement Differs in Term and Whole Life Policies

Both types promise a death benefit. The coverage period and cash value features change how the clause reads in practice.

Term life insurance covers a death benefit for a stated period. Whole life insurance is permanent coverage, and its cash value is described in its own provisions.

Policy loan rules differ by type. Under Fla. Stat. § 627.458, the loan provisions do not apply to term policies or to term benefits provided by riders. For whole life, the loan provision applies after the policy has a cash surrender value and no premium is in default. Fla. Stat. § 627.458 reads: “The loan value of the policy shall be at least equal to the cash surrender value at the end of the then-current policy year, except that the insurer may deduct, either from such loan value or from the proceeds of the loan, any existing indebtedness not already deducted in determining such cash surrender value, including any interest then accrued but not due, any unpaid balance of the premium for the current policy year, and interest on the loan to the end of the current policy year.”

Age-based adjustments sit in their own provisions. If the age or sex of the insured, or of any other individual considered in determining the premium or benefit, was misstated, Fla. The owner, insured and beneficiary roles decide who receives the money.

Florida law limits who may buy coverage on another person. Fla. Stat. § 627.404 says that when someone procures insurance on another individual’s life or body, benefits must be payable to the insured, the insured’s personal representatives, or a person with an insurable interest when the contract is made.

Proceeds can also reach an estate. Under Fla. Stat. § 222.13, when a person residing in Florida dies leaving insurance payable to the insured, the insured’s estate, or the executors, administrators, or assigns, the proceeds become part of the insured’s estate. Fla. Stat. § 222.13 reads: “Notwithstanding the foregoing, whenever the insurance, by designation or otherwise, is payable to the insured or to the insured’s estate or to his or her executors, administrators, or assigns, the insurance proceeds shall become a part of the insured’s estate for all purposes and shall be administered by the personal representative of the estate of the insured in accordance with the probate laws of the state in like manner as other assets of the insured’s estate.” It is then handled under probate law.

Federal tax treatment also depends on ownership. Whether life insurance proceeds are taxable depends on the facts of each case, and key person policies can raise questions worth discussing in a coverage review. Under 26 U.S.C. § 2042, proceeds are included in the gross estate to the extent receivable by the executor as insurance under policies on the decedent’s life, and to the extent receivable by other beneficiaries when the decedent held incidents of ownership in the policy at death.

NR CPAs & Business Advisors is a Miami CPA firm.
