Citizenship alone is not the test. Eligibility depends on your immigration status, where you live, and the insurer’s underwriting rules. Insurers look at residency, identification, age, and health answers. Each insurer sets its own standards, so two companies can answer the same applicant differently.

This page covers green card holders, visa holders, non-resident Indians (NRIs), and undocumented applicants. It also covers moving abroad and estate questions. If you’re researching for a spouse, parent, or sibling, start with the rules on who may buy a policy.

Florida law sets the basic rules. Under Fla. Stat. § 627.404, you may buy a policy on your own life for anyone’s benefit. Buying a policy on another person’s life requires an insurable interest when the contract is made, unless the benefits are payable to that insured or his or her personal representatives. Unless the policy is a prepaid funeral contract, group life insurance, or group or blanket accident, health, or disability insurance, that person, having legal capacity to contract, must also apply for or consent in writing to the contract and its terms on or before the time the contract is made, except that a person with an insurable interest in a minor younger than 15, or a person on whom that minor depends for support, may obtain a policy on the minor. An insurable interest can come from a close family tie or from a substantial financial loss if the insured dies.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Can green card holders get life insurance in the USA?

Yes, green card holders generally apply much the way US citizens living in the country do. Permanent resident status is a starting point, not the final answer. The insurer still decides whether to issue the policy and on what terms.

Insurers may ask for identity and residency documents. Examples include a green card, a passport, or a Social Security number. The accepted list changes from one insurer to the next, so check it before you gather papers.

If you plan to live abroad for a long stretch, tell the insurer before you apply. A move can change the residence questions on an application. It can also affect how the policy is handled later.

Term life insurance is a common starting point for families with a mortgage, young children, or a spouse who depends on the income. FINRA’s life insurance overview explains that term coverage lasts for a limited period. Whole life insurance covers the insured’s lifetime and includes a cash-value feature.

Visa holders and temporary residents: what carriers look at

Visa holders can apply for life insurance, but the visa type and length of stay can affect eligibility. Work visas such as the H-1B are common examples. An insurer may ask how long you have lived in the US and how long your status is expected to last.

Insurers want to know that coverage fits your stay. A change in status, a new job, or a planned departure can affect an application already in progress. Tell your agent about any change before the policy is issued.

Consider a buyer on a work visa who wants a term policy to protect a spouse and a child. The insurer would review the visa and the expected length of stay before making an offer. For more detail on that category, read our H-1B term life insurance guide.

NRI life insurance and buying coverage from outside the US

An NRI, or non-resident Indian, is a person of Indian citizenship or origin who lives outside India. Some NRIs apply for US coverage while they live abroad. Insurer rules for buyers living outside the US often differ from the rules for US residents. Both the policy and the buyer’s location matter.

Ask how the insurer treats applicants who live outside the country before you apply. Rules on residence, premium payment, and communication can all change the process.

Whether a beneficiary receives the death benefit depends on the policy terms and the facts of the claim. For a person residing in Florida who dies, Fla. Stat. § 222.13 provides that insurance on that person’s life shall inure exclusively to the benefit of the person for whose use and benefit it is designated in the policy. Fla. Stat. § 222.13 reads: “(1) Whenever any person residing in the state shall die leaving insurance on his or her life, the said insurance shall inure exclusively to the benefit of the person for whose use and benefit such insurance is designated in the policy, and the proceeds thereof shall be exempt from the claims of creditors of the insured unless the insurance policy or a valid assignment thereof provides otherwise.” If the insurance is payable to the insured or to the insured’s estate, the insurance proceeds become a part of the insured’s estate. Notwithstanding that rule, if the insurance is payable to the insured, to the insured’s estate, or to the estate’s executors, administrators, or assigns, the proceeds become part of the insured’s estate for all purposes and are administered under the probate laws of Florida. Issue may depend on insurability. Your answers can affect whether the insurer issues the policy and on what terms.

Each insurer sets its own identification rules. These can include whether it asks for a Social Security number or another tax ID.

Undocumented immigrants face a different set of questions. Carriers set their own rules for applicants who lack a Social Security number or certain status documents. The documents accepted differ by carrier, and no single standard applies to every applicant. A coverage review can sort out which documents a given insurer accepts.

Estate planning and tax questions for non-citizens

Estate tax rules for nonresident non-citizens differ from the rules for US citizens. 26 U.S.C. § 2101 imposes a tax on the transfer of the taxable estate of a decedent who is a nonresident and not a US citizen. Those rights, called incidents of ownership, include a reversionary interest, but only if its value exceeded 5 percent of the policy’s value immediately before the decedent’s death.

For income tax, 26 U.S.C. § 101 generally excludes death benefits paid because of the insured’s death from gross income. A transfer for value can change that result.
