Whether a term policy’s death benefit counts toward a taxable estate depends on who owns the policy, who is named as beneficiary, and the rules that apply at death. This page explains the general rules and shows where a coverage review fits. It is general information, not tax or legal advice.

What Term Life Insurance Does in Estate Planning

Term life insurance pays a death benefit to named beneficiaries if the insured dies during a set term. Coverage ends when the term ends, unless the policy is renewed or converted under its own terms.

A term contract does not build cash value under the contract. In an estate plan, the death benefit can give beneficiaries or the estate cash. That cash may help with final expenses, debts or other short-term needs. How it helps depends on the plan and the policy.

This topic often matters to:

Business owners whose company interests may be hard to sell quickly

People whose estates hold property that is not easily turned into cash

Families with assets or obligations in more than one country

The level-premium period, renewal terms and conversion rights are set by the specific policy and insurer. Premiums depend on the insurer, the policy, underwriting and the individual’s circumstances.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Is Life Insurance Included in Your Taxable Estate?

Life insurance can be counted in a taxable estate, depending on the facts. Under federal law, the gross estate includes insurance receivable by the executor. It also includes insurance receivable by other beneficiaries when the decedent held any incidents of ownership at death (IRC § 2042).

A transfer of a policy can also matter. Under IRC § 2035, certain property transferred during a look-back period before death may be included in the gross estate, depending on the facts and the rules that apply to the transfer.

Ownership and beneficiary designations are the key variables. The same policy can be treated differently depending on who owns it and who is named. Estate tax treatment depends on the policy, the contract, applicable rules, the size of the estate and the individual’s circumstances. The IRS estate tax guidance explains how the federal estate tax applies in general.

Some families discuss an irrevocable life insurance trust. It has its own rules and administration. We can explain how such a structure would be evaluated in your case. This is general information, not tax advice.

Do Beneficiaries Pay Income Tax on Term Life Proceeds?

Often, beneficiaries do not owe federal income tax on a death benefit paid as a lump sum. Exceptions apply. For example, the rules can change when a policy was transferred for value. Interest earned on proceeds left with the insurer after death is generally taxable. The IRS FAQ on life insurance proceeds covers the general treatment.

Income tax on proceeds is a different question from estate tax on the estate’s value. People often mix the two up. Treatment depends on the policy, how it was owned and transferred, and the beneficiary’s situation. No outcome is certain until those facts are reviewed. This is general information, not tax advice.

What Happens When Proceeds Go to the Estate

Naming a person as beneficiary is different from naming the estate. Under Florida law, when insurance is payable to the insured, to the insured’s estate, or to executors, the proceeds become part of the insured’s estate. They are then administered under probate law (Fla. Stat. § 222.13).

Probate can add time and cost, depending on the estate and the facts. The same statute says proceeds payable to a named beneficiary may be exempt from the insured’s creditors, unless the policy or a valid assignment provides otherwise.

Cash can matter when an estate holds assets that are hard to sell, such as a home or a business interest. Proceeds may provide cash for expenses. How the money is used depends on the estate’s terms.

Review beneficiary designations after a marriage, divorce, a new child or a change in business ownership. An outdated form can send proceeds somewhere you did not intend.

Term coverage ends at the end of its term. Renewal or conversion depends on the policy, the insurer and the insured’s insurability at that time. Neither is assured.

Have questions about what happened?

Ask our team directly.
