The first is NRIs and visa holders in the United States who have parents, children or other dependents in India. The second is green card families who support relatives abroad or hold assets in both countries. The third is business owners with cross-border ties who want to protect a company or an ownership agreement.

If that describes you, you may be asking several questions. Which type of coverage fits? Who should be the beneficiary? Does an Indian policy raise US reporting questions? How could tax and estate rules in two countries affect the plan?

This guide does not answer those questions for any one person. Each answer depends on the policy, the insurer, the contract and the individual’s facts. The sections below cover the main decisions, so you know what to ask before a coverage review.

How US and Indian Life Insurance Differ

A life insurance policy is a contract. Coverage and benefits depend on the issuing insurer’s underwriting and the terms of the policy. Policies bought in India and policies bought in the United States use different products, forms and paperwork.

Age limits, eligibility and required documents vary by insurer. They can also depend on the policyholder’s residency status. Two people of the same age may face different questions because their residency, premiums and claim paperwork differ.

That is why one general answer does not fit every case. Before you buy a policy or keep an existing one, review the full contract. A summary alone can leave out important terms.

Choosing Between Term and Whole Life Coverage

Term life insurance pays a death benefit if the insured dies during a set period. Whole life insurance is permanent coverage that may build cash value under the contract. Each one plays a different role in a plan.

Term coverage is often used for a set period, such as years when others depend on the insured’s income. Whole life may suit a longer-term need. Its cash value consists of guaranteed and non-guaranteed amounts. The amounts depend on the insurer and the contract.

Some people start with a rule of thumb, such as a multiple of annual income. This is a rough starting point only, not a definitive answer. The right amount depends on what is being protected, such as a mortgage, children’s education or a business obligation. Age and circumstances can change both the cost and the amount needed.

Premiums and term length depend on the insurer, the policy, underwriting and the individual’s circumstances. For more detail, see our whole life insurance for NRI families page and our term life insurance page.

Naming Beneficiaries Across Borders

A beneficiary is the person or entity who receives the death benefit. A primary beneficiary is first in line. A contingent beneficiary receives the benefit if the primary beneficiary cannot.

When a parent or relative lives in India, the designation should be exact. Use full legal names. Update the designation after marriage, divorce, births or deaths. Clear wording helps prevent disputes and delays.

Payment logistics, currency and bank transfer questions depend on the insurer and the policy terms. Ask how the insurer pays a beneficiary outside the United States before you buy.

A death benefit is paid subject to the policy terms, the insurer’s review and the claim documents submitted. It is not automatic. Florida law allows a person to buy insurance on their own life for the benefit of any person. Fla. Stat. § 627.404 sets out the insurable interest rules.

What Changes If the Policyholder Moves or Changes Status

A move or a change in visa or citizenship status can raise questions. These may involve premium payments, policy servicing, claim handling and the insurer’s address records.

Florida law (Fla. Stat. 627.453) sets a grace-period requirement for late premiums on life insurance policies. Under the statute, a grace period applies to each premium due after the first, and a premium unpaid during the grace period may be deducted from the proceeds if a claim arises. The policy continues in force during that time, and the insurer may charge interest within limits. Fla. Stat. § 627.453 states this rule.

Transfers of ownership also need review. Gifts made within three years of death can be pulled into an estate in some cases. Our three-year rule explainer covers this as a topic to discuss, not a fixed rule.

Before any move, review the policy and the insurer’s documents. Any change in coverage depends on insurability and circumstances at that time. Future increases are not assured.

Have questions about what happened?

Ask our team directly. A ULIP, or unit-linked insurance plan, combines life cover with investment funds linked to the market. These products differ from US term and whole life policies, so they need a separate review.

Whether an Indian policy must be reported on a US return depends on the policy structure, the holder’s residency and the reporting rules that apply. Questions can come up about foreign financial accounts and foreign insurance. The answers depend on the facts.

This is general information, not tax advice. If you hold an existing Indian policy, our accounting practice can review the reporting questions it raises with you. The IRS publishes an FAQ on life insurance proceeds that explains federal treatment of death benefits received by a beneficiary.

US Tax Questions on Death Benefits and Cash Value

Death benefits are often discussed as income tax questions. Under IRC § 101, gross income does not include amounts received under a life insurance contract if such amounts are paid by reason of the insured’s death, subject to the exceptions in that section. Exceptions apply, including transfers for value and interest paid on proceeds. Treatment depends on the policy, the contract and the individual’s circumstances.

Estate inclusion is a separate question. Under IRC § 2042, proceeds may be included in the decedent’s gross estate in certain cases. One case is when the executor receives them. Another is when the decedent held incidents of ownership at death. Whether this applies depends on the facts.

Cash value consists of guaranteed and non-guaranteed amounts. A policy loan or withdrawal can reduce both the cash value and the death benefit. Terms depend on the policy. Florida law allows a policy loan on a policy with a cash surrender value, and the policy may end if debt reaches the loan value after notice. Fla. Stat. § 627.458 sets out these rules.

Dividends, where a policy pays them, are not guaranteed. Premium deductibility depends on the policy, the business structure and the client’s situation. Under IRC § 264, no deduction is allowed for premiums on a life insurance policy if the taxpayer is directly or indirectly a beneficiary under the policy, subject to the other limits in that section. This is general information, not tax advice.

Key Person and Buy-Sell Coverage for Cross-Border Business Owners

Key person insurance covers a person whose role matters to a business. Buy-sell agreement insurance can fund an agreed transfer of an owner’s interest. Both depend on the policy terms and the business agreement.

Florida law lets a business entity have an insurable interest in owners, officers, partners, managers or key persons. Written consent must be obtained before the insurance is bought. Fla. Stat. § 627.404 states this rule. A party to a contract to buy or sell a business interest also has an insurable interest in the other parties’ lives for that contract.

For cross-border owners, the agreement should state which country’s rules apply. It should also say who pays premiums and who owns each policy. Ownership and beneficiary choices can affect tax and estate questions.

Some buyers or investors may consider coverage when they value a business. This is one factor, and it depends on the case and the policy terms. It is not a guaranteed result. See our key person insurance and buy-sell agreement insurance pages.

Coordinating Life Insurance in a Two-Country Estate

A two-country estate can include assets, heirs or guardians in both countries. Coordinated beneficiary, ownership and trust decisions can help the plan work as a whole. Coordination does not guarantee any result.

Estate planning life insurance provides funds for estate needs, such as expenses or taxes. Whether proceeds are included in an estate depends on the applicable rules, the ownership and the individual’s situation. Under IRC § 2035, certain transfers made within three years of death may also be included.

Federal estate and gift figures are set each year. IRS Revenue Procedure amends § 2010(c)(3) by increasing the basic exclusion amount to $15,000,000 for calendar year 2026. These figures are general references. They do not measure any individual’s exposure.

This guide does not cover wills, trusts or foreign law. The insurance review covers the policy side of the plan.

Want to know where you stand?

Tell us about your situation and our team will walk you through the options available to you.

Request a coverage review

Request a coverage review

Premium Costs and What Drives Them

Premiums depend on several factors. These include age, health and underwriting, coverage amount, policy type, term length and the insurer. No single premium applies to every reader.

Two illustrative pages show how cost is set up: the cost of a $1,000,000 term policy and the cost of a $100,000 policy. Use them as examples of structure, not as your price.

Premium terms depend on the level-premium period in the specific policy and contract. Premiums are variable figures. They depend on the insurer, the policy, underwriting and the individual’s circumstances.

Accurate application details matter. Florida law says that if the insured’s age or sex was misstated, the benefit is adjusted to what the premium would have bought at the correct age.

Policy Terms to Review: Review Period, Claims and Limits

For a life insurance policy, Florida law provides a 14-day review period, during which the owner can examine the policy and decide whether to return it, subject to the issuing insurer’s policy terms. The Florida Department of Financial Services guide describes this look period for life policies. The insurer’s terms control how it works.

Coverage, premiums and benefits depend on the issuing insurer’s underwriting and the policy’s terms. Exclusions and limitations apply. A claim is paid only after the insurer reviews the documents and approves payment.

Health history matters. It can affect whether a policy is issued and how claims are handled. Fully underwritten policies include health questions, and issue may depend on insurability.

Florida law requires life policies to become incontestable after two years from issue during the insured’s lifetime. The rule has exceptions, including nonpayment of premiums.

When you read a policy summary, check guaranteed and non-guaranteed values separately. Look for age-based changes and dividend language. Dividends are not guaranteed.

Next Steps: Insurance Through Nischay Rawal and Accounting Services Separately

Insurance is offered through Nischay Rawal, a Florida-licensed insurance agent.
