In many cases the answer is yes, but eligibility depends on the insurer, the applicant’s residency or visa status, and the policy itself. This guide covers the questions that come up most for US life insurance for families with ties to India, including visa holders, beneficiaries, parents abroad, existing Indian policies and US tax reporting.

Everything here is general information. It is not tax, legal or immigration advice. Each answer depends on the policy, the insurer’s underwriting and your personal situation.

Who This Guide Is For and How to Use It

This guide is for three groups. The first is people on visas who live in the United States and want coverage. The second is NRIs, meaning Non-Resident Indians living abroad, who need coverage that works across borders. The third is US residents with parents, children or other beneficiaries in India.

Use this page as a map. Each section answers one common question. Read the sections that match your situation first, then follow the links to our deeper guides.

Keep one idea in mind throughout. The insurer’s rules, the policy’s terms and your own circumstances decide the outcome. A general guide cannot tell you what an insurer will accept, what a policy will cost or how a claim will be paid.

Readers in Florida, including Miami, Fort Lauderdale, West Palm Beach, Orlando, Tampa and Jacksonville, will find Florida-specific points where they matter. Examples include insurable interest and policy loan rules.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Can Non-US Citizens Get US Life Insurance?

Non-US citizens can sometimes get US life insurance, but each insurer sets its own eligibility rules. Insurers may ask about residency, visa type, identification and the country where you live. One insurer may accept an applicant that another declines.

Holders of non-permanent resident visas often face the most questions. An insurer may review how long the visa lasts, your current status and your plans to stay in the United States. Those details can change which policies are open to you. Ask about them in a coverage review rather than assuming an answer.

Asylum seekers, refugees and people without legal status raise separate questions. This guide does not address those situations. They need individual review before any step is taken.

Florida law also limits who can buy insurance on someone else’s life. Under Fla. Stat. § 627.404, a person generally may not buy insurance on another individual’s life unless the benefits are payable to that individual or to someone with an insurable interest when the contract is made.

For the basics on eligibility and residency, see our NRI life insurance guide.

Visa Status, Green Cards and Documents Insurers May Request

Insurers commonly ask for proof of identity, a visa or residency document and an address history. These are examples only. The exact list depends on the insurer, the policy and your status. Some applicants may also be asked for a taxpayer identification number.

Timelines vary too. An application can take longer when the insurer needs more papers or follow-up. Plan for that delay if a visa renewal or move is on your calendar.

Gather identity papers, status papers and address records before you apply. Missing documents are a common reason an application slows down. Bring copies of anything you’re not sure you need.

In a coverage review, we can explain the application steps in plain words. We can walk through what the insurer has asked for and why. We cannot promise that any application will be accepted.

Can a Non-US Citizen Be a Beneficiary?

A beneficiary’s citizenship does not decide the question by itself. Whether a relative in India can be named depends on the insurer’s rules and the policy’s terms. Confirm both before you name anyone.

Every policy has three roles. The owner holds the policy and makes choices about it. The insured is the person whose life is covered. The beneficiary receives the death benefit. One person can fill more than one role, or each role can belong to a different person. These roles matter for tax and estate questions, which we cover below.

A death benefit is paid under the policy’s terms after the insurer reviews the claim and its documents. Payment is not certain in every case. Florida law generally exempts proceeds payable to a designated beneficiary from the insured’s creditors. The exemption applies unless the policy or a valid assignment provides otherwise. Under Fla. Stat. § 222.13, proceeds payable to the insured or the insured’s estate become part of that estate.

Review beneficiary designations when family life changes. Common triggers include marriage, a new child or a move abroad. Updating a designation depends on the policy’s rules.

Buying Life Insurance for Parents in Another Country

A US resident may be able to buy life insurance on a parent living in India, but insurers set their own standards. Florida law requires an insurable interest in the insured’s life. For an individual, it also requires that the insured apply for or consent in writing to the contract.

Health history, age and residency can affect whether an insurer issues a policy and what it charges. Underwriting makes that decision, and each insurer uses its own criteria. Age can also change both the cost and the coverage amount that fits a family’s needs.

Availability for a parent abroad depends on the insurer. Some companies may not write coverage on people who live outside the United States. Ask the insurer what it accepts before you build a plan around one policy.

Age reporting also matters. Florida law says that if an insured’s age has been misstated, the benefit is adjusted to what the premium would have bought at the correct age. Get the date of birth right on the application.

Term or Whole Life for Cross-Border Families

Term life insurance covers a set period. Whole life insurance is designed to last for the insured’s whole life. Both can fit cross-border families, but they work differently. The right choice depends on the policy, the insurer and your needs. The NAIC Life Insurance Buyer’s Guide describes term and permanent coverage and questions to ask before buying.

Term premiums depend on the level-premium period stated in the specific policy and contract. After that period, premiums may change. Check the contract for the exact terms.

Whole life insurance may build cash value under the contract. That value includes guaranteed and non-guaranteed amounts. Non-guaranteed amounts are not promised. Loans or withdrawals can reduce both the cash value and the death benefit. Florida’s policy loan rules apply after a policy has a cash surrender value and no premium is in default. Those rules do not apply to term policies.

Whole life is life insurance first. It is not a savings account or an investment plan.

Some families use a multiple of annual income as a rule of thumb for coverage. Treat that as a general starting point only, not a required amount. The right fit depends on what you need to protect, such as a mortgage, childcare or support for a parent. Explore our term life insurance and whole life insurance guides for more detail.

Have questions about what happened?

Ask our team directly. A US policy also does not automatically replace an Indian one. Each contract has its own terms, and each insurer applies its own rules.

Many readers review existing coverage before they add a new policy. That review shows what is already in place, what it covers and what might change if you move, retire or return to India. Do not cancel or change an existing policy until you understand its terms.

Replacing one policy with another can involve new underwriting, changes to coverage and costs. The effects depend on the contracts involved and on your situation. Ask before you act.

This page does not compare or rank insurers. Send questions about existing contracts to this firm, so they can be reviewed together.

US Tax and Reporting Questions for Foreign Policies

US tax treatment of life insurance depends on the policy, the contract, applicable rules and your situation. This section is general information, not tax advice.

Under federal law, amounts received because of the insured’s death are generally excluded from the beneficiary’s gross income. Exceptions apply. They include certain transfers of a policy and some employer-owned contracts. The IRS guidance on life insurance proceeds explains how federal reporting applies to proceeds.

Income tax and estate tax are separate questions. Under IRC § 2042, the value of the gross estate includes amounts receivable by the executor as insurance under policies on the life of the decedent. It can also include insurance receivable by other beneficiaries when the decedent held incidents of ownership at death. Those rules do not apply the same way to every policy.

Whether any premium is deductible depends on the policy type, the business structure and your situation. Do not assume a deduction. Cross-border reporting for an Indian policy may raise separate questions that need individual review.

Estate Planning, Ownership and Beneficiaries Across Borders

Ownership and beneficiary choices can shape how a policy fits into an estate plan. Estate planning life insurance uses a policy to support goals such as paying estate costs or providing for heirs. Its results depend on the policy, applicable rules and your situation.

Cross-border estates add questions. Assets, family members and legal rules may sit in more than one country. Florida and federal rules can both apply. These questions need individual review, not a general answer.

A trust can also own a policy. Florida law sets rules on when a trust has an insurable interest in the insured. See Fla. Stat. § 627.404.

A business with owners or key people in India may consider key person insurance or buy-sell agreement insurance. Under Florida law, a business may have an insurable interest in key people only if they consent in writing before the policy is bought. The business may not retaliate against someone who declines.

Coverage alone does not change a business’s value. Some buyers may consider it as one factor, depending on the case and the policy terms.

What Drives the Cost of a Policy, Including the $1,000,000 Question

A monthly cost for a $1,000,000 policy depends on many factors. No general figure fits every family. This guide does not quote a premium.

The main factors include:

The insurer and its underwriting standards

The policy type, such as term or whole life

The insured’s age and health

The term length and the level-premium period in the contract

Riders and other features added to the policy

Premiums are variable figures, not fixed amounts. Premium terms depend on the specific contract. Some contracts can change premiums after the level-premium period ends.

One common rule of thumb ties coverage to a multiple of income. Use it as a starting point only. It does not set the amount your family needs.

Under Florida law, you have 14 days after you receive a life insurance policy to review it and return it for a refund, as the policy terms provide.

Life policies also generally become incontestable after a set period. Under Fla. Stat. § 627.455, a policy must be incontestable after 2 years from its date of issue. Exceptions apply, including nonpayment of premiums.

Want to know where you stand?

Tell us about your situation and our team will walk you through the options available to you.

Request a coverage review

Request a coverage review

Next Step: Request a Coverage Review With Nischay Rawal

The next step is a coverage review, which is a first meeting to talk through your situation.
