It can stay in force for the insured person’s lifetime, as long as the policy terms and premium payments are met. It pays a death benefit to a named beneficiary. It may also build cash value under the contract. This guide covers whole life insurance for families, business owners and cross-border households in Florida, including Miami, Fort Lauderdale, West Palm Beach, Orlando, Tampa and Jacksonville. It is general information. Your own policy’s terms control.

What Whole Life Insurance Is

Whole life insurance is a type of permanent life insurance meant to last for the insured’s lifetime. That lasting coverage depends on the policy terms, the insurer’s underwriting and continued premium payment. Permanent coverage differs from term life insurance, which covers a set period. Neither type is better for every household. The right choice depends on how long coverage is needed and what the household can manage. The Florida Department of Financial Services life insurance guide explains the main types of life insurance in plain language. Use it as background only. The features of any real policy come from that policy’s own contract.

Not sure what your next step is?

Talk it through with our team — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a coverage review

Schedule a coverage review

Ownership, Beneficiary and Payer Roles

Three roles shape every policy. The insured person is the one whose life is covered. The owner holds the contract rights, such as the right to borrow or change the beneficiary, as the contract allows. The beneficiary receives the death benefit. One person can hold more than one role, or each role can belong to someone different. The premium payer can also be a separate person. That choice affects who controls the policy and who holds its cash value.

Ownership also matters for estate purposes. Under IRC § 2042, proceeds payable to the executor are included in the gross estate. Proceeds payable to other beneficiaries are included if the decedent held any incident of ownership at death. Estate inclusion therefore depends on who owns the policy, not only on who receives the money. Ownership and beneficiary designations are set in the contract. They can be changed only as the policy and insurer allow. This is general information, not tax advice.

Cash Value: Guaranteed and Non-Guaranteed Amounts

Cash value is the amount a whole life policy may build under its contract over time. It is not a savings account, an investment or a retirement plan. Cash value consists of guaranteed amounts stated in the policy and non-guaranteed amounts. Non-guaranteed amounts depend on the insurer’s experience and the policy’s terms. The guaranteed part is written into the contract. The non-guaranteed part can rise or fall.

Some whole life policies pay dividends. Dividends are not guaranteed. Illustrations show possible values under stated assumptions. They are not promises. Every illustration has limits, and the assumptions behind it deserve equal attention. Ask which part of any number is guaranteed and which part is not. Those answers come from the specific policy and insurer, not from a general page.

Policy Loans and Withdrawals

A policy loan lets the owner borrow against the policy’s cash value. Loan terms depend on the policy and the insurer. Florida law sets some basic rules. Under Fla. Stat. § 627.458, an insurer may advance a loan after the policy has a cash surrender value and no premium is in default. The insurer may defer granting a loan for 6 months after application. The statute also allows a policy to terminate if total indebtedness, including interest, equals or exceeds the loan value. Termination requires at least 30 days’ notice mailed to the insured or policyowner.

Loans and withdrawals can reduce both the cash value and the death benefit. Unpaid loan interest can be added to the loan balance. A loan that is not repaid can lower the amount paid at death. Review the contract’s loan provisions, repayment terms and lapse risk before any decision. This statute does not apply to term policies.

Tax Questions to Raise With Your Policy in View

Tax results depend on the policy, its ownership and the owner’s situation. A CPA would start with a few questions. How are premiums treated for the household or business? How is cash value treated if the policy is surrendered or borrowed against? Does the policy meet the federal tests for life insurance? Under IRC § 101, amounts paid by reason of death are generally excluded from gross income. Exceptions apply. Interest paid on proceeds left with the insurer can be taxable.

Whether a policy becomes a modified endowment contract depends on its premium history under IRC § 7702A. Under IRC § 264, no deduction is allowed for premiums on a policy if the taxpayer is directly or indirectly a beneficiary. Deductibility depends on the policy, the business structure and the taxpayer’s situation. This section is general information, not tax advice. NR CPAs & Business Advisors’ accounting practice reviews tax questions separately from insurance placement.

Have questions about what happened?

Ask our team directly. Ask how long coverage is needed. Ask what premium level fits the household’s cash flow. Ask whether permanent coverage fits the goal. Term life insurance covers a set period, and many households use it for a defined need. Whole life insurance can cover the insured’s lifetime while its terms are met, and it may build cash value.

Each type has trade-offs. Term coverage ends when its period ends, unless the policy allows renewal or conversion on its own terms. Whole life carries a different premium structure and a different cash value picture. Premiums and costs depend on the insurer, the policy, underwriting and the individual’s circumstances. No single cost figure applies to every reader. The whole life and term life pages in this series explain these trade-offs in more detail. Keep the comparison tied to the specific policy under review, using that policy’s own figures.

Cross-Border Households: Policies Owned in the US, Beneficiaries or Payers Abroad

A cross-border household has ties to more than one country. Common questions include who owns the policy, who pays the premiums, where the beneficiary lives and which currency is used. Florida law limits insurance on another person’s life. Under Fla. Stat. § 627.404, an individual may insure his or her own life for the benefit of anyone. Insurance on another person’s life is allowed only if the benefits are payable to that insured, the insured’s personal representatives, or someone with an insurable interest when the contract was made.

A move abroad can affect premium payment, policy administration and reporting. The effect depends on the insurer and the rules that apply. A policy held in another country raises its own reporting and tax questions. Federal figures give some context. The IRS gift tax FAQ lists the 2026 gift tax annual exclusion at $19,000 per donee. These are tax figures. They are not measures of how much life insurance a household needs. The firm does not claim special understanding of any national or ethnic group. Each case depends on the specific policy and circumstances.

Business Owner Uses: Key Person, Buy-Sell and Estate Planning

Business owners often look at key person coverage, buy-sell funding and estate planning. Key person insurance is a policy a business may own on an essential person. The business is the beneficiary, subject to the insurer’s underwriting and approval. Under Fla. Stat. § 627.404, a business entity may insure owners, key persons or key employees if written consent is obtained before the insurance is purchased. Parties to a contract to buy or sell a business interest have an insurable interest in each other’s lives for that contract only.

Buy-sell agreement insurance is one funding method some owners consider for an ownership transfer. The agreement terms and tax results depend on the business structure. Some buyers or investors may consider insurance coverage as one factor. That does not establish any valuation outcome for a business. Employer-owned policies can carry return-filing duties under IRC § 6039I, depending on the contract.

Estate planning life insurance is one tool some families use. Under IRC § 2035, a transfer of an interest in property made within three years of death can bring that property into the gross estate. The statute includes exceptions, such as a bona fide sale for adequate and full consideration. Estate inclusion and tax treatment depend on the policy, the applicable rules and the individual’s circumstances.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is the cash value of whole life insurance?

Cash value is the amount a whole life policy may build under its contract.
